Anlass dieser Arbeit war das Urteil des Bundesverfassungsgerichts zu heimlichen Vaterschaftstests vom 13.02.2007. Das Verfassungsgericht billigte darin die BGH-Rechtsprechung, wonach heimliche Vaterschaftstests unverwertbar sind. Gleichzeitig verpflichtete es den Gesetzgeber ein Verfahren einzuführen, das es Vätern ermöglicht, unabhängig vom Anfechtungsverfahren ihre biologische Vaterschaft zu überprüfen. Die Arbeit analysiert das Urteil des Bundesverfassungsgerichts sowie den neu eingeführten § 1598 a BGB. Gleichzeitig wird der Frage nachgegangen, warum die Kenntnis der eigenen biologischen Vaterschaft ein persönlichkeitsbildender Faktor sein soll. Anhand der gefundenen Ergebnisse werden Perspektiven für ein neues Abstammungsrecht aufgezeigt.
