Früher stand Klägern dafür vor allem die Prozesskostenhilfe, das Darlehen oder die Rechtsschutzversicherung zur Verfügung. Seither hat sich nicht nur die gewerbliche Prozessfinanzierung in Deutschland etabliert, sondern das Legal-Tech-Masseninkasso als neues Rechtsdurchsetzungsmodell hat den Gesetzgeber veranlasst, das Erfolgshonorarverbot weiter zu lockern und im gleichen Atemzug die anwaltliche Prozessfinanzierung als neues Finanzierungsmodell einzuführen. Das Werk geht den Fragen nach, die sich rund um die Finanzierung von Zivilprozessen und damit um die Inanspruchnahme dieser Finanzierungsmodelle stellen. Dabei werden insbesondere die verfassungsrechtlichen Vorgaben, die Voraussetzungen und Wirkungen der Finanzierungsmodelle sowie ihr Verhältnis zueinander, die Erstattung von Finanzierungskosten und Situationen, in denen ein besonderes Bedürfnis nach einer Fremdfinanzierung besteht, untersucht.
