Studienarbeit aus dem Jahr 2015 im Fachbereich VWL - Sonstiges, Note: 1,0, Ruprecht-Karls-Universität Heidelberg (Philosophisches Seminar), Veranstaltung: Philosophie der Wirtschaft, Sprache: Deutsch, Abstract: Die vorliegende Arbeit nimmt Wolfgang Streecks "Gekaufte Zeit" als Ausgangspunkt für die Analyse und Diskussion der Rolle des Menschen innerhalb einer Gesellschaft, in der das politische Primat gegenüber ökonomischen Imperativen an Boden verliert und Effizienzfragen für Parlamentswahlen bedeutender werden, als Fragen normativen Couleurs. Zu diesem Zweck soll zunächst nachvollzogen werden, wie der Kapitalismus in der Darstellung Streecks‘ nach 1945 mit der Demokratie in Einklang gebracht wurde und was zum Bruch dieses Einverständnisses in den 1970er Jahren führte. In diesem Zusammenhang soll auch kurz zur Sprache kommen, wie ein finaler Zusammenbruch des Systems und die damit einhergehende Krise bisher verhindert wurden. In einem zweiten Schritt wird analysiert, welche Bedeutung die beschriebenen Verän-derungen und Verschiebungen der Gestaltungspräferenzen für Politik und Ökonomie haben. Welche Auswirkungen ergeben sich für die Menschen durch einen Paradigmenwechseln vom politischen zum ökonomischen Imperativ? Der Hauptteil dieser Arbeit widmet sich schließlich der Frage, welche Rolle der Mensch in einem Staat spielt, der Träger der von Streeck beschriebenen Charakteristika des demokratischen Kapitalismus nach 1970 ist. Ausgehend vom Menschenbild Adam Smiths‘ wird zu zeigen versucht, wo der Mensch innerhalb des Gefüges Ökonomie-Politik-Gesellschaft theoretisch verortet ist. Anschließend soll untersucht werden, inwiefern diese Vorstellung im modernen demokratischen Kapitalismus als verwirklicht betrachtet werden können. Abschließend wird ein kleiner Ausblick auf einen möglichen Umgang mit dem von Streeck beschriebenen Dilemma gegeben.

This title explores the normative foundations of European contract law. It addresses fundamental political questions on contract law in Europe from the perspective of leading contemporary political theories. Does the law of contract need a democratic basis? To what extent should it be Europeanised? What justifies the binding force of contract and the main remedies for breach? When should weaker parties be protected? Should market transactions be considered legally void when they are immoral? Which rules of contract law should the parties be free to opt out of? Adopting a critical lens, this book interrogates utilitarian, liberal-egalitarian, libertarian, communitarian, civic republican, and discourse-theoretical political philosophies and analyses the answers they provide to these questions. It also situates these theoretical debates within the context of the political landscape of European contract law and the divergent views expressed by lawmakers, legal academics, and other stakeholders. This work moves beyond the acquis positivism, market reductionism, and private law essentialism that tend to dominate these conversations and foregrounds normative complexity. The concept of public action is a magnifying lens for shedding light on the plurality of institutional and social actors interacting in policies. Taking into account a changing social world that is redefining the State and its instruments, it is well suited for picking out transformations that have been affecting European social policies for some twenty years or so now: the territorial reorganization of powers; the spread of a public-private mix in the provision of services; the rise of new forms of collaborative governance; the institutionalization of the European agenda on social investment. This book examines social policies as normative and cognitive devices that contribute to organizing social life and are themselves moulded and redefined by it. The perspective of public action is located where it is possible to observe how these devices come into action, the powers and interests they help mobilize and the dynamics they generate. Policies thus appear as a tangle of rather diverse processes in which the erosion of the ‘social’ coexists with the emergence of innovative forms of social organization. Public action is the key tool that helps to deal with this tangle by posing the following questions. What vocabularies, significances and practices are set in motion by the ‘social’ today? What are the resources that fuel it? What powers are deployed in it?
