Dennoch stehen in diesen Ländern auch Produkte aus Staaten zum Verkauf, in denen diesem Arbeiterschutz nur eine untergeordnete oder gar keine Bedeutung zukommt.1 Diese paradox anmutende Situation, seit Jahren vielfach öffentlich kritisiert, wird von Menschenrechtsorganisationen2 und Forschern verschiedener Disziplinen als Folge von Globalisierungsprozessen verstanden. Durch die rapide Vermehrung und Verdichtung grenzüberschreitender gesellschaftlicher Interaktionen nutzen immer mehr Unternehmen die Möglichkeit, das mobil gewordene Kapital in Regionen zu investieren, in denen sie aufgrund günstigerer Arbeitskräfte und des Fehlens sozialer Standards die maximale Rendite erzielen können.3 Es sind aber vor allem jene Länder, in die das Kapital von Unternehmen aus Industrienationen fließt, die Sozialstandards im Sinne von Arbeiterrechten vielfach nicht beachten. Daher ist die Durchsetzung von internationalen Sozialstandards stets auch eine Komponente des Nord-Süd- Konfliktes, der unter anderem in der ungleichen Wirtschaftskraft der jeweiligen Länder begründet ist.4 Industrienationen sowie Entwicklungs- und Schwellenländer konkurrieren auf dem internationalen Wirtschaftsmarkt. Das Problem der Missachtung internationaler Sozialstandards ist daher eng mit globaler Wirtschaftspolitik im Kontext der Globalisierung verknüpft. Trotz des skizzierten aktuellen Zusammenhangs der unbefriedigenden Einhaltung internationaler Arbeiterrechte gehen die ersten Versuche zur Formulierung und Durchsetzung dieser Normen bereits auf die Zeit der Industrialisierung zurück. Die Gründung der International Labour Organisation (ILO) nach dem ersten Weltkrieg war einer der ersten multilateralen Lösungsansätze auf internationaler Ebene und löste die vorangegangenen bilateralen Lösungsansätze ab.5 Es folgten weitere Maßnahmen6, so z.B. in jüngerer Vergangenheit der Global Compact, der sich an multinationale Unternehmen wendet und eine freiwillige Einhaltung von Umwelt- und Sozialstandards dieser Unternehmen unter Aufsicht der United Nations (UN) vorsieht.7 Die Bilanz der bisher unternommenen Maßnahmen hat zwar zu einem hohen Grad der internationalen Normierung von Sozialstandards geführt, jedoch die Einhaltung dieser Standards nicht im selben Maße erreicht. Die Analyse der Hintergründe dieser Entwicklung ist Aufgabe dieser Arbeit.

Hit by the European financial and economic crisis in 2008, several Member States of the European Monetary Union (EMU) were unable to refinance their public debt through the financial markets.
