Das Werk befasst sich im Rahmen der optimierenden Rechtseuropäisierung in der Europäischen Union schwerpunktmäßig mit dem Konzept der Grundrechte der finnischen Verfassung von 2000. Diese werden mit der Europäischen Menschenrechtskonvention (1950), der Europäischen Grundrechtecharta (2000/2004) und dem deutschen Grundgesetz (1949) verglichen. Im ersten Teil werden die wichtigsten Fragen der allgemeinen Grundrechtslehre erörtert. Der zweite Teil untersucht verschiedene Einzelgrundrechte. Hierfür wurden das Recht auf Eigentum, das Recht auf eine eigene Sprache und Kultur sowie das Recht auf soziale Unterstützung ausgewählt. Im letzten Teil werden die Übereinstimmungen wie Unterschiede aufzeigenden Ergebnisse der Untersuchung zusammengefasst.

Im Ergebnis gewahrleistet die EU Versammlungsfreiheit neben Art. 12 EuGrCh auch durch ein ungeschriebenes Unionsgrundrecht. Der Autor widmet sich zudem offenen Fragen zur Versammlungsfreiheit des Art. 11 EMRK. Eine wertende Rechtsvergleichung bestimmt schliesslich die Konturen der EU-Versammlungsfreiheit und zeigt dabei eine den Mitgliedstaaten gemeinsame Verfassungstradition des Grundrechts auf, das sich auch insofern als Europaische Versammlungsfreiheit erweist.

In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

Despite the international community’s recognition of social protection as a human right, the vast majority of the world’s population still has no access to social protection. In a major effort to address this situation, the International Labour Conference unanimously adopted the Social Protection Floors Recommendation 202 of 2012.
