Parody is a most iridescent phenomenon: of ancient Greek origin, parody's very malleability has allowed it to survive and to conquer Western cultures. Changing discourse on parody, its complex relationship with related humorous forms (e.g. travesty, burlesque, satire), its ability to cross genre boundaries, the many parodies handed down by tradition, and its ubiquity in contemporary culture all testify to its multifaceted nature. No wonder that 'parody' has become a phrase without clear meaning. The essays in this collection reflect the multidimensionality of recent parody studies. They pay tribute to its long and varied tradition, covering examples of parodic practice from the Middle Ages to the present day and dealing with English, American, postcolonial, Austrian, and German parodies. The papers range from the Medieval classics (e.g. Chaucer), parodies of Shakespeare, and the role of parody in German Romanticism, to parodies of fin-de-si�cle literature and the intertextual puzzles of the late twentieth century (such as cross-dressing, Schwab's Faustparody, and Rushdie's Satanic Verses). And they have transformed the contentious nature of parody into a diverse range of methodologies. In doing so, these essays offer a survey of the current state of parody studies.

Durch eine Markenparodie macht sich der Parodist gleich einem Parasiten unbefugt den Aufmerksamkeits- und Werbeeffekt der fremden Marke zu Nutze, sei es zur Kommunikation seiner Kritik bzw. seines Kunstwerkes oder als Kaufanreiz für sein Produkt. Zugleich verletzt er das aufwändig kreierte Image der Marke. Diese Arbeit untersucht, inwieweit der Markeninhaber (marken-)rechtlich gegen die Parodie seiner Marke vorgehen kann. Die parodistische Verwendung immaterialgüterrechtlich geschützter Gestaltungen und die Rechte und Interessen des Parodierten stehen in einem Konflikt. Während der Parodist stets auf die Übernahme der prägenden Elemente angewiesen ist, ist eine derartige Übernahme grundsätzlich dem Inhaber des Immaterialgüterrechts vorbehalten. Dieses umfassende Verbotsrecht kollidiert mit der grundrechtlich geschützten Kunst- und Meinungsfreiheit des Parodisten. Melanie Horn arbeitet Abwägungskriterien heraus, die eine gerechte Lösung des Interessenkonflikts ermöglichen. Während die Interessen des Parodisten im Urheberrecht keine Berücksichtigung fanden, kann die Zulässigkeit der Parodie im Marken- und Designrecht anhand einer Gesamtschau der einschlägigen Normen beurteilt werden. Die Autorin schlägt deshalb die Einführung einer Parodieschranke ähnlich der durch das Gesetz zur Anpassung des Urheberrechts an die Erfordernisse des digitalen Binnenmarktes vom 31. Mai 2021 (BGBl. I 1204) mit § 51a UrhG erstmals ausdrücklich geregelten Schranke für Parodien vor.The parodic use of creations protected by intellectual property act and the rights and interests of the person being parodied create a conflict. The parodist constantly depends on accessible identifying elements. However, this access is strictly reserved for the owner of the intellectual property right. This comprehensive right conflicts with the parodist's freedom of art and speech, guaranteed by jurisdiction. Melanie Horn develops defining criteria that enable a fair solution for the conflict of interest. While the interests of the parodist were not considered in copyright law, the acceptance of the parody in the trademark and design act can be evaluated by the relevant norms. The author therefore proposes the introduction of a parody barrier similar to the parody barrier introduced in the Gesetz zur Anpassung des Urheberrechts an die Erfordernisse des digitalen Binnenmarktes (Federal Law Gazette I 1204).
