English summary: In the field of patent law, the interests of the holder of a patent and those of the general public are diametrically opposed. The holder of the patent is interested in obtaining a sole and exclusive right which is as comprehensive as possible, whereas the general public wishes to have free access to technical knowledge. It is the lawmaker's function to create an appropriate balance between these interests. Tobias Timmann questions whether or not Article 14 of the German Basic Law contains concrete guidelines for the lawmakers to define patent law. He comes to the conclusion that patent law is subject to the institutional guarantee of property and thus studies those specifications which are mandatory for the creation of patent law. In conclusion, he applies the basic principles which he has developed to a selection of problem cases in patent law. German description: Im Bereich des Patentrechts stehen sich die Interessen des Patentinhabers und der Allgemeinheit diametral gegenuber. Der Patentinhaber hat ein Interesse an einem moglichst umfassenden Ausschliesslichkeitsrecht, wahrend die Allgemeinheit einen unbehinderten Zugang zu technischem Wissen wunscht. Es ergibt sich die Herausforderung, einen sachgerechten Ausgleich zwischen diesen Interessen zu schaffen. Diese Aufgabe kommt dem Gesetzgeber zu. Tobias Timmann befasst sich in seiner Untersuchung mit der Frage, ob Art. 14 GG konkrete Richtlinien fur die Ausgestaltung des Patentrechts durch den Gesetzgeber bereithalt.Das Bundesverfassungsgericht bejaht dies in standiger Rechtsprechung. Der Autor zeigt auf, dass dies auf einer schlichten Ubertragung von zum Urheberrecht entwickelten Grundsatzen auf das Patentrecht basiert, welche aber abzulehnen ist. Er fuhrt eine selbstandige Betrachtung fur den Bereich des Patentrechts durch und zeigt dabei, dass das Patentrecht der Institutsgarantie des Eigentums unterfallt. Dies beruht auf mehreren Faktoren: der Geschichte des Erfindungsschutzes, den Eigentumstheorien und dem Kriterium der personlichen Leistung. In Folge dieses Ergebnisses wird anschliessend der durch die Institutsgarantie geschutzte Kernbereich bestimmt. Hierbei ist zu beachten, dass das Patent grundsatzlich als Ausschliesslichkeitsrecht auszugestalten ist, so dass die Voraussetzungen zu bestimmen sind, unter denen das Patent dennoch durch den Gesetzgeber eingeschrankt werden darf. Hierbei ist zwischen Eingriffen in das Verfugungs- und das Verwertungsrecht zu unterscheiden.
