Die deutsche Einkommensteuer feierte 1991 den 100. Geburtstag seit Einführung des preußischen Gesetzes. Von Anfang an wurde die Ausrichtung der inneren Systematik des Gesetzes auf Erfassung der Steuerpflichtigen nach ihrer Leistungsfähigkeit gerühmt. In dieser Abhandlung führt der Autor den das Einkommensteuergesetz bestimmenden Aufbau auf die Kombination von zwei unterschiedlichen Besteuerungsideen zurück: das dem preußischen Einkommensteuergesetz als Reformmuster dienende sächsische Gesetz von 1878 sowie das preußische Einkommensteuergesetz von 1891. Ein Vorteil des Systems ist die bei hoher Ergiebigkeit dieser Besteuerung innewohnende Möglichkeit zur verborgenen Begünstigung verschiedenartigster wirtschaftspolitischer Ziele. Diese Fähigkeit hat die Überbrückung der wirtschaftlichen Schwierigkeiten nach zwei Weltkriegen ermöglicht und dem Gesetz das Überleben gesichert. Dennoch besteht heute große Unzufriedenheit mit dem Gesetz. Der Gesetzesvollzug erscheint dem Autor besonders vordringlich reformbedürftig zu sein.
