English summary: Knut Wolfgang Norr presents a legal history of the Federal Republic of Germany, from its origins up to the Grand Coalition, as seen in the context of its economic system and constitution. He shows the development of a 'two-lane' economic system in the Federal Republic between the Weimar tradition and the new ordoliberalism, which was stabilized by the broad, consensus-producing principle of social market economy. He analyzes inter alia the origins of various basic statutes, the independence of the federal bank, and the unions' struggle for co-determination. The fundamental, though unsolved problem of economic power may be called the leitmotif of the study. Dabei treten Entwicklungsprozesse in den Vordergrund, die bis in die unmittelbare Gegenwart weiterwirken.Ausgehend vom Begriff der Wirtschaftsverfassung der Weimarer Periode zeigt er die Herausbildung einer 'zweispurigen' Wirtschaftsordnung in der Bundesrepublik zwischen Weimarer Tradition und neuem ordoliberalen Denken, die durch den konsensstiftenden weiten Begriff der Sozialen Marktwirtschaft stabilisiert wurde. Er analysiert die Entstehungsgeschichte verschiedener konstitutiver Gesetze, die fur das Erscheinungsbild der Bundesrepublik als Wirtschaftsordnung entscheidend sind. Dabei wird die stete Wiederkehr grundsatzlicher Fragen der Wirtschaftsverfassung sichtbar. Das fundamentale, gleichwohl ungeloste Problem der wirtschaftlichen Macht bleibt immer prasent.Am Beispiel der Mitbestimmung zeigt der Autor, wie die Gewerkschaften ihre Wirtschaftskonzeption nicht im Rahmen der Staatsorganisation umsetzen konnten, sondern sich auf die Ebenen des Betriebs und Unternehmens beschranken mussten. Ferner analysiert er die Entstehungsgeschichte der unabhangigen Bundesbank. In einem Kapitel uber die Konzentrationsdebatte wird deutlich, dass der Staat die Konzentration einerseits unter dem Aspekt der Mittelstandspolitik eindammte, ihr jedoch auf der anderen Seite aus verschiedenen Grunden nicht ablehnend gegenuberstand. Abschliessend schildert er unter finanzierungs- und eigentumspolitischen Aspekten die Aktienrechtsreform von 1965 und demonstriert, wie der Schutz des Aktionars im neuen Konzernrecht zugleich die Konzernbildung legitimierte.

The aim of this book is to explore and reflect upon preconditions of a specific European social dimension, or more specifically of a European social citizenship. Welfare and social policies in Europe are deeply entrenched in state histories; the success of the welfare state stems from its ability during a fairly long historical period to unify social citizenship, full employment, mass education and a functional industrial relations system. The historical connection between welfare regimes built upon the nation state, and popular democracy founded in party voting, makes the deepening and widening of a common European project a highly risky undertaking and an open process with a radically uncertain outcome. The dilemma in the form of uneasy relationships among national welfare regimes and the evolutionary process of increased market integration - driven both by market forces (globalisation) and the European Union as a political project - is well known and has been demonstrated by different commentators. Every step of deepening market integration in Europe tends to threaten and put pressure on the existing national welfare regimes. As their own populations generally support them, the legitimacy of the EU is at risk.
