Jens Eisfeld wendet sich grundsätzlich gegen eine "eheschließungsrechtliche" Lösung des Scheineheproblems, also gegen ein Ehehindernis der Scheinehe, das sowohl eine Weigerungspflicht des Standesbeamten begründet, als auch eine nachträgliche Auflösung der bereits geschlossenen Ehe ermöglicht. Er legt eine dezidiert rechtshistorische Untersuchung der Geschichte der Scheinehe im 19. und 20. Jahrhundert vor, die sowohl rechtspolitische, als auch rechtsdogmatische Argumente gegen den bestehenden Eheaufhebungsgrund der Scheinehe (§ 1314 Abs. 2 Nr. 5 BGB) liefert, der seit 1998 geltendes Recht ist. Diese Regelung hält Jens Eisfeld für verfassungswidrig. Einen Schwerpunkt der rechtshistorischen Analyse stellt die Zeit des "Dritten Reichs" dar. Die Nationalsozialisten normierten erstmals Ehehindernisse der Scheinehe, die einen wesentlichen Beitrag zu der Begründung eines "völkischen" Eherechts leisten konnten.
