Städte und Gemeinden sind seit jeher wichtige Stützen des schweizerischen Bundesstaates. Rechtswissenschaftlich sind die Städte erst ansatzweise untersucht. Die vorliegende Dissertation umreisst die Entwicklungsgeschichte der schweizerischen Städtelandschaft und geht auf zukünftige Herausforderungen ein. Die Rechtsstellung einer Stadt wird in erster Linie durch das kantonale Recht geregelt. Hierbei findet sich eine grosse, föderalistisch bedingte Vielfalt, wie bereits die Eingrenzung von Begrifflichkeiten zeigt. Auch Bundesrecht befasst sich punktuell mit den Städten und Gemeinden. Die Arbeit stellt die Rechtsgrundlagen zur Positionierung der Städte und Gemeinden im föderalistischen Gefüge dar. Basis bildet der gemeinsame Rechtsrahmen für Städte wie andere Gemeinden. Betrachtet werden ihre Existenz und Bestand, Organisation, Zuständigkeiten und Aufgaben, Autonomie und Subsidiarität, Möglichkeiten der politischen Mitwirkung sowie Zusammenarbeit mit anderen Städten und Gemeinden. Dabei wird aufgezeigt, wie Kantone und Bund insbesondere die Städte auf vielfältige Art und Weise «besonders» behandeln und vom allgemeinen Gemeinderecht abweichen. Zum Abschluss würdigt die Arbeit verschiedene Reformvorschläge mit Städtebezug und ihre rechtlichen Implikationen.
