Nach überwiegender Meinung unterliegt der Schuldner im deutschen Leistungsstörungsrecht einer Verschuldenshaftung, in anderen Rechtsordnungen hingegen einer Garantiehaftung. Holger Sutschet analysiert die Entwicklung der vertraglichen Haftung und kommt zu einem anderen Ergebnis: Bleibt die Leistung aus, so hat der Schuldner das Gläubigerinteresse am Erhalt der Leistung in Geld auszugleichen (Geldkondemnation). Holger Sutschet arbeitet den Unterschied zwischen dieser Haftung auf das Interesse und der Haftung für Schäden, welche als Garantiehaftung wie auch als Verschuldenshaftung vorkommen kann und vorkommt, heraus.
