History and memory rank as central themes in the philosophy of Friedrich Nietzsche. As one of the last philosophers of the 19th century, Nietzsche naturally belongs to the so-called ‘historical century’. The contentious exchange with the past and with antiquity – as much as the mechanisms, the dangers, and the lessons of memory and tradition – are continually examined and stand in close relationship with Nietzsche’s vision of life and his project of human development. As Jacob Burckhardt once wrote of the cultural critique to his Basel colleague: "Fundamentally, you are always teaching history" (9/13/1882). Following Burckhardt’s judgment, the contributors focus on the analysis of core questions in the philosophies of history and memory, and their respective convergence in the thought of Nietzsche. The epistemological relevance of these central concepts will be thematized alongside those concerning tradition, and education. The discussion of these rich themes unifies a broad spectrum of questions, ranging from cultural memory to contemporary philosophy of mind. The contributions are revised versions of selected papers presented at the 2018 conference of the annual meeting of the Nietzsche Society in Naumburg.

Quod decet? Diese Frage stellt sich in jeder rhetorischen Situation, in der ein Orator seinem Anliegen durch eine Rede Geltung beim Rezipienten verschaffen möchte. Angemessenheit ist eine genuin rhetorische Kategorie und dennoch ist das Postulat der Angemessenheit bislang kaum Gegenstand moderner Rhetorikforschung geworden. Das Konzept der Angemessenheit stellt die rhetorische Theorie vor ein Problem, da es erstens mehrere Begriffe dafür gibt (aptum, prepon, decorum), die durch Übersetzung vom Altgriechischen ins Lateinische tradiert worden sind. Zweitens erweist sich die Angemessenheit über die Jahrhunderte hinweg als ein interdisziplinäres Thema, dessen ephemeres Wesen in der Theorie der Rhetorik nur schwer zu fassen ist. Gerade deshalb ist eine für das digitale Heute festgelegte Bestimmung von prepon/decorum in der Rhetorik nötig, da sich die Rhetorik in der Auseinandersetzung zwischen dem Ideal des rationalen Argumentierens und den rhetorischen Effizienzansprüchen doch bis heute behaupten muss.

Ever since, courts have been struggling with the definition of what makes a remuneration "equitable". Jochen Christoph Hegener analyzes the entire existing case law and systemizes the most common criteria used by the courts. It further identifies the most pressing and current questions for courts in defining an equitable remuneration according to § 32(2) of the German Copyright Act today.
