Vor dem Hintergrund der aktuellen Entwicklungen innerhalb und außerhalb der EU zur Frage der sachgerechten Vergütung des Versicherungsmaklers behandelt der ehemalige Hauptgeschäftsführer des BIPAR, Ass. jur. Harald Krauß, in dieser Arbeit sowohl die verschiedenen nationalen Vergütungsusancen als auch die Vor- und Nachteile der Vergütungsalternativen Courtage/Honorar. Der Autor beleuchtet eingangs die Stellung des Versicherungsmaklers aus wirtschaftlicher und rechtlicher Sicht, insbesondere das Doppelrechtsverhältnis sowohl zum Kunden als auch zum Versicherer. Des Weiteren behandelt das Werk ausführlich die Frage, inwieweit die Courtagezahlung des Versicherers und die Sachwalterpflichten gegenüber dem betreuten Kunden zu einem Interessenkonflikt beim Versicherungsmakler führen. Beispielhaft werden verschiedene nationale Lösungsalternativen - auch aus verwandten Wirtschaftszweigen - dargestellt und bewertet. Ebenso wird die Vergütungsalternative in Gestalt der Honorarzahlung durch den Versicherungsnehmer mit ihren Vor- und Nachteilen behandelt und vertieft auf die Konsequenzen für das Steuerrecht und die Position des Maklers im Vergaberecht eingegangen. Der Autor plädiert für eine sachliche Auseinandersetzung mit den verschiedenen Vergütungssystemen und vor allem auch für eine faire Beurteilung der Courtage. Gleichzeitig warnt er aufgrund seiner internationalen Erfahrung vor einer obligatorischen Einführung eines Honorarsystems, da insbesondere der Wunsch privater Verbraucher nach unabhängiger Versicherungsvermittlung hierdurch kaum befriedigt werden kann. Diese Untersuchung ist ein wertvoller Diskussionsbeitrag zur generellen Vergütungsproblematik, die speziell für die Versicherungsvermittlung von grundlegender Bedeutung ist.

The model’s value add is investigated based on two survey-based studies from the automotive and the electricity industry.
