Today, audiovisual archives and libraries have become very popular especially in the field of collecting, preserving and transmitting cultural heritage. However, the data in these archives or libraries - videos, images, soundtracks, etc. - constitute as such only potential cognitive resources for a given public (or “target community”). One of the most crucial issues of digital audiovisual libraries is indeed to enable users to actively appropriate audiovisual resources for their own concern (in research, education or any other professional or non-professional context). This means, an adaptation of the audiovisual data to the specific needs of a user or user group can be represented by small and closed "communities" as well as by networks of open communities around the globe. "Active appropriation" is, basically speaking, the use of existing digital audiovisual resources by users or user communities according to their expectations, needs, interests or desires. This process presupposes: 1) the definition and development of models or "scenarios" of cognitive processing of videos by the user; 2) the availability of tools necessary for defining, developing, reusing and sharing meta-linguistic resources such as thesauruses, ontologies or description models by users or user communities. Both aspects are central to the so-called semiotic turn in dealing with digital (audiovisual) texts, corpora of texts or again entire (audiovisual) archives and libraries. They demonstrate practically and theoretically the well-known “from data to metadata” or “from (simple) information to (relevant) knowledge” problem, which obviously directly influences the effective use, social impact and relevancy, and therefore also the future, of digital knowledge archives. They demonstrate practically and theoretically the well-known "from data to meta-data" or "from (simple) information to (relevant) knowledge" problem – a problem that obviously directly influences the effective use, the social impact and relevancy and therefore also the future of digital knowledge archives. It constitutes, indeed, the heart of a diversity of important R&D programs and projects all over the world.

The archives of many television broadcasters now contain material which includes more than half a century of contemporary, documentary and entertainment history and are of immense cultural and economic value. Digitisation has created an entirely new technical basis for making these assets available to a wide audience, and there are a whole range of projects aimed at opening up audiovisual archives (including those of broadcasters). Examples that might be mentioned are the BBC Creative Archive, the Dutch Filmotech initiative or the French Inamâdiapro database. However, many projects that open up broadcasters' archives and exploit them online, generally run up against serious problems when it comes to clearing the rights for these archived works. These problems arise, firstly, due to a contractual practice that developed in the pre-digital era and to aspects of copyright law that do not really meet the needs of the digital age. Secondly, the very large number of works stored in archives constitutes a challenge that is not easily overcome. The aim of this IRIS Special publication is to discuss the subject of "Digitisation and online exploitation of broadcasters' archives" from a number of different perspectives. The team of authors involved is accordingly made up of representatives of many different interests: copyright holders and those who look after their interests, television broadcasters, lawyers and copyright experts. This IRIS Special thus not only provides you with legal guidance but is at the same time a field report written by specialists who are facing the challenge of opening up broadcasters' archives to a wide audience. By working out existing problems that have hitherto not been satisfactorily resolved, both policy-makers and legislators are shown where immediate action is needed.
