Each country is the subject of two chapters — one on the history of design and the other on the history of design law — authored by experts in design and intellectual property (IP) law. This unique interdisciplinary approach explains why and how various national design protection systems (that can include design, copyright, trade mark, competition and civil laws) developed, making it an ideal book for students, researchers and lawyers. The book also serves as an international survey of different national policy and legal responses to historical developments and specific design and legal issues allowing readers to consider their advantages and disadvantages — and so is also recommended for policy and law makers, as well as organizations that administer IP rights. Over the course of several decades, copyright protection has been expanded and extended through legislative changes occasioned by national and international developments. The content and technology industries affected by copyright and its exceptions, and in some cases balancing the two, have become increasingly important as sources of economic growth, relatively high-paying jobs, and exports. Since the expansion of digital technology in the mid-1990s, they have undergone a technological revolution that has disrupted long-established modes of creating, distributing, and using works ranging from literature and news to film and music to scientific publications and computer software. In the United States and internationally, these disruptive changes have given rise to a strident debate over copyright's proper scope and terms and means of its enforcement-a debate between those who believe the digital revolution is progressively undermining the copyright protection essential to encourage the funding, creation, and distribution of new works and those who believe that enhancements to copyright are inhibiting technological innovation and free expression. Copyright in the Digital Era: Building Evidence for Policy examines a range of questions regarding copyright policy by using a variety of methods, such as case studies, international and sectoral comparisons, and experiments and surveys. This report is especially critical in light of digital age developments that may, for example, change the incentive calculus for various actors in the copyright system, impact the costs of voluntary copyright transactions, pose new enforcement challenges, and change the optimal balance between copyright protection and exceptions.

Neste quarto título da coleção Democracia Digital, a professora Maria Carlotto apresenta um tema caro às novas formas de produção, edição e distribuição de conteúdos impulsionadas com o advento das redes digitais: propriedade intelectual. A autora reconstrói a história da ideia de propriedade intelectual, desde a legislação aprovada em Veneza, em 1474, que pela primeira vez protegia o monopólio sobre a exploração de invenções, até as discussões recentes. Com capítulos como "A história da propriedade intelectual", "O predomínio da perspectiva utilitarista" e "O problema moral da tensão entre proteção e acesso", a autora refaz o percurso do que chama de "judicialização" da propriedade industrial, do direito autoral e da proteção de cultivares (seres vivos, como plantas medicinais). Como escreve Maria Caramez Carlotto, no livro: "O surgimento das tecnologias de informação e comunicação alterou radicalmente a forma como a humanidade produz e troca conteúdos. Isso marca a emergência de uma nova forma de produção de cultura, em que cada indivíduo torna-se um produtor cultural em potencial. (...) Por essa importância crescente e decisiva, as escolhas relativas à legislação de propriedade intelectual deveriam se dar da maneira mais democrática possível, envolvendo de forma efetiva a comunidade política formada pelo conjunto dos cidadãos e cidadãs. No entanto, o que observamos ao longo dos últimos 50 anos – período em que as leis de propriedade intelectual têm sofrido, no mundo todo, alterações profundas no sentido de seu fortalecimento – é o oposto disso".
