Temas relacionados à polícia estão cada vez mais em voga, tendo em vista a escalada da corrupção e da violência nos centros urbanos e a aparente ineficiência da administração pública em manter a ordem e tornar a persecução penal efetiva, o que tem suscitado frequentes debates entre acadêmicos, policiais, políticos e demais interessados no tópico denominado "segurança pública". Todavia, no plano jurídico, nota-se um nítido descompasso entre o estudo da polícia e a importância do tema. As escassas obras da primeira metade do século passado praticamente não foram sucedidas após o até hoje em vigor CPP de 1941. Tal diploma, ao concentrar disposições legais sobre polícia judiciária, propiciou a dicotomização dos supervenientes estudos sobre a polícia, de forma a encontrar-se parcialmente contemplada em obras no âmbito direito processual penal, e administrativo, ambos sem o devido aprofundamento em sua normatização. No entanto, a polícia, enquanto objeto de estudo, extravasa o direito administrativo ou processual penal para ganhar conotação juridicamente transdisciplinar. Por sua vez, tal cenário propiciou que a relevância da polícia nos estudos jurídicos permanecesse diminuída, com as pesquisas sobre a matéria carecendo de abrangência e coesão sistêmica, não sendo exagerado afirmar que esta, em diversos dos seus aspectos, é praticamente uma ilustre desconhecida, sendo, na maior parte das vezes, sobejamente incompreendida, tanto por juristas como pela própria sociedade. Tal incompreensão, como se observará a seguir, certamente se refletiu em nosso ordenamento jurídico, permeado por uma legislação sobre o tema que tem se desenvolvido disfuncionalmente, e onde não raras vezes a polícia é tratada de maneira lacônica e sistematicamente imprecisa. Diante disto, objetiva este trabalho estudar de forma didática e coesa a polícia no ordenamento jurídico brasileiro, a partir do resgate dos seus conceitos jurídicos, em especial na análise dos seus aspectos funcionais, sem deixar de submeter tais premissas a irradiação de todo arcabouço principiológico emanado pela CF de 1988. Com isso, busca-se contribuir para que acadêmicos e profissionais do direito, assim como demais interessados no estudo da polícia, possam subsidiar suas pesquisas a respeito, a partir da perspectiva do direito policial como um ramo autônomo no âmbito do direito público.

"America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Most people think that the Supreme Court has a rough balance between left and right.
