The process of construction of national states had a decisive moment during the period of revolutions that spanned from the end of the eighteenth century until the mid-nineteenth century. Even if it was a generalized process throughout the Western world, the majority of social scientists that have analyzed it have based their theoretical models on the European and North American experiences. Knowledge of the pragmatici sheds new light on pragmatic normative literature (mainly from the religious sphere), a genre crucial for the formation of normative orders in early modern Ibero-America. Long underrated by legal historical scholarship, these media – manuals for confessors, catechisms, and moral theological literature – selected and localised normative knowledge for the colonial worlds and thus shaped the language of normativity. The eleven chapters of this book explore the circulation and the uses of pragmatic normative texts in the Iberian peninsula, in New Spain, Peru, New Granada and Brazil. O objetivo deste livro é o de propor uma ampla reflexão sobre o Judiciário e o seu governo, ou seja, como os seus órgãos exercem suas garantias constitucionais de autonomia institucional, discutindo os fundamentos teóricos, modelos e funções do governo judicial, adotando, como recorte, a sua atribuição de realizar a gestão e o controle do estatuto da magistratura, elemento considerado como predominante nos tipos comparados de governo da Justiça. Partindo da imagem do "arquipélago da Justiça" como representativa das posições críticas à organização, funcionamento e eficiência dos órgãos judiciários, e tomando a categoria do governo judicial como campo analítico, o livro apresenta uma discussão das fontes históricas e teóricas da formação do modelo brasileiro, que justificam o arranjo adotado pela ordem constitucional de 1988, complementada pela Reforma Judiciária de 2004.
