O presente estudo verificou se juízos especializados do primeiro grau de jurisdição do Tribunal de Justiça da Paraíba, ao decidirem sobre a necessidade de retirada de crianças e adolescentes da posse materna, respeitam e protegem o seu direito fundamental à convivência materno-filial, esgotando medidas protetivas menos drásticas e facilitando a reintegração familiar. Por expressa determinação legal, deve-se preservar a família natural até o momento em que se comprove a incapacidade do/a/s genitor/a/es de prover à criança ou ao adolescente os cuidados básicos e inerentes à autoridade parental e que exponha o/a/s filho/a/s a uma situação de risco. Contudo, persiste uma questão de gênero a ser debatida em relação ao que se compreende como devido exercício do encargo, dado que a mesma sociedade que condiciona a mulher ao casamento e à maternidade, não lhe garante o igual acesso ao trabalho, à renda, à saúde, ao planejamento familiar, entre outros direitos sociais básicos. Logo, a intervenção estatal na família, lastreada unicamente na condição de vulnerabilidade socioeconômica materna, mesmo que a pretexto de proteção do superior interesse infanto-juvenil, pode se demonstrar abusiva. A pertinência desse estudo se justifica pela denúncia reiterada de órgãos nacionais da rede de proteção à infância e meios de comunicação de que mulheres brasileiras têm sido alijadas da posse de seus filhos menores, sem qualquer acusação formal de abuso ou negligência no exercício do cuidado. A pesquisa realizada é do tipo descritiva, bibliográfica e documental, com o emprego do método dedutivo de abordagem. Quanto ao procedimento, é funcionalista, comparativa e de interpretação. Parte-se dos paradigmas da Constitucionalização do Direito Civil, fenômeno jurídico que erigiu, sem prejuízo de outros, os princípios da dignidade da pessoa humana, solidariedade e da doutrina da proteção integral para nortear a proteção das famílias, bem como da Teoria Feminista do Direito, desenvolvida por juristas como Tove Stang Dahl e Martha Albertson Fineman, para compreender a situação de desigualdade sociojurídica feminina, em seu sentido material. Ao final do estudo, concluiu-se que, na Paraíba, órgãos jurisdicionais violam o direito à convivência materno-filial, com base num padrão de moralidade discriminatória, que, antes de acolher, nega as vulnerabilidades.

National human rights institutions—state agencies charged with protecting and promoting human rights domestically—have proliferated dramatically since the 1990s; today more than a hundred countries have NHRIs, with dozens more seeking to join the global trend. These institutions are found in states of all sizes—from the Maldives and Barbados to South Africa, Mexico, and India; they exist in conflict zones and comparatively stable democracies alike. In Chains of Justice, Sonia Cardenas offers a sweeping historical and global account of the emergence of NHRIs, linking their growing prominence to the contradictions and possibilities of the modern state. As human rights norms gained visibility at the end of the twentieth century, states began creating NHRIs based on the idea that if international human rights standards were ever to take root, they had to be firmly implanted within countries—impacting domestic laws and administrative practices and even systems of education. However, this very position within a complex state makes it particularly challenging to assess the design and influence of NHRIs: some observers are inclined to associate NHRIs with ideals of restraint and accountability, whereas others are suspicious of these institutions as "pretenders" in democratic disguise. In her theoretically and politically grounded examination, Cardenas tackles the role of NHRIs, asking how we can understand the global diffusion of these institutions, including why individual states decide to create an NHRI at a particular time while others resist the trend. She explores the influence of these institutions in states seeking mostly to appease international audiences as well as their value in places where respect for human rights is already strong. Disability-inclusive development is an essential condition for a sustainable future.
