L’opera affronta l’importante, e sempre attuale, tematica della salute e della sicurezza sul posto di lavoro, partendo dall’esame di principi generali delineati dalle disposizioni normative, per poi soffermarsi sull’ampia casistica fornita dalle decisioni degli organi giudicanti e delineare, infine, le situazioni nella quali è ravvisabile un comportamento colposo e quindi sanzionabile. Dopo l’inquadramento fornito dal codice civile e dal codice della sicurezza sul lavoro, viene considerata la normativa europea, l’assetto costituzionale delle fonti, il sistema civile derivante dall’art. 2087 c.c. e il sistema penale, la responsabilità degli enti e la problematica compatibilità con i reati colposi. Si analizza inoltre il modello di organizzazione, gestione e controllo previsto dagli artt. 30-300 del d.lgs. n. 81/2008, la delega di funzioni, la sospensione dell’attività imprenditoriale. Ampio spazio viene poi riservato al rapporto tra sicurezza e infortuni sul lavoro, responsabilità e danno e al ruolo del Giudice e dell’INAIL nell’applicazione della normativa sulle malattie professionali. Di particolare interesse applicativo è la sezione dedicata ai soggetti attivi e passivi coinvolti nella gestione della sicurezza, alla valutazione dei rischi e degli strumenti di prevenzione e alle tutele collettive. Infine vengono analizzate alcune situazioni particolari, legate alla sicurezza negli appalti e nei cantieri, alla prevenzione e responsabilità del rischio-amianto e infine all’individuazione e alla tutela dei soggetti nei casi di mobbing.

The volume analyses the theme of "business risk" with an original and interdisciplinary approach from a dual point of view: the control and internal management of risks by the company, and the criteria for imputing liability for damages relating to the carried out activity. On the first point, consideration is given to the obligations of preparing adequate organizational models to prevent damage, even in situations of "unknown technology", and initiatives aimed at encouraging "socially responsible" conduct, such as ethical codes. On the other point, there are the problems relating to the most effective civil liability models to allocate the cost of harmful events on the subject who created the relative risk and not on the victim who suffers from them or on the community. In the second part of the volume, the topic is addressed with particular reference to the environment sector, which is the most profitable and also the current laboratory for testing the interconnections between prevention and fixing, conduct obligations and rules of responsibility, to the extent that the economic costs are charged to the operator in order to prevent, reduce or eliminate damage to the environment.
