La legge n. 164 del 14 aprile 1982 sulla rettificazione di attribuzione di sesso stabilisce che il Tribunale possa autorizzare l’operazione chirurgica di riassegnazione sessuale quando esistano delle condizioni psico-fisiche accertate medicalmente. Solo quando la transizione da un sesso all’altro è completata il giudice ordina la rettificazione degli atti dello stato civile per quanto riguarda il sesso e il nome. La legge lascia aperte, però, molte questioni. Tra queste le più importanti sono 1) il fatto che non vengono fissati i criteri che il giudice deve seguire nella decisione di autorizzazione dell’intervento chirurgico e 2) il fatto che la legge non interviene a tutelare i diritti delle persone in transizione. Il seguente lavoro vuole essere spunto per una discussione soprattutto su questi aspetti.
