All’approccio sostanzialistico abitualmente riservato allo studio e all’analisi del diritto sopranazionale e internazionale dei diritti umani viene ora ad aggiungersi un’opera, non rinvenibile nella letteratura comparata, che affronta in modo sistematico, in un’ottica completamente innovativa, i profili processuali della protezione delle libertà fondamentali con riferimento alla tutela multilivello articolata tra ambito delle Nazioni Unite, Corte penale internazionale, Corte europea dei diritti dell’uomo e Corte di giustizia dell’Unione europea. Ampio spazio viene dedicato anche al sistema interamericano e al sistema africano di tutela dei diritti umani, incentrati – rispettivamente – sulla Corte interamericana dei diritti dell’uomo e sulla Corte africana dei diritti dell’uomo e dei popoli. L’opera è rivolta agli operatori del diritto e agli studiosi che a vario titolo (magistrati, avvocati, docenti, studenti, pubblici amministratori) dedicano la propria vita professionale all’applicazione dei diritti umani contribuendo alla loro effettività. Luca Mezzetti Professore ordinario di Diritto costituzionale presso il Dipartimento di Scienze giuridiche nella Scuola di Giurisprudenza dell’Università di Bologna, ove insegna anche Diritti fondamentali e Diritto dei Paesi islamici. È direttore della Scuola superiore di studi giuridici dell’Università di Bologna e professore di Diritto pubblico nella Università “L. Bocconi” di Milano. È membro onorario dell’Associazione argentina di Diritto costituzionale e membro del comitato scientifico di varie riviste giuridiche italiane e straniere. È inoltre presidente della Sezione italiana dell’Instituto Iberoamericano de Derecho Constitucional. Calogero Pizzolo Professore di Diritto costituzionale, Diritti umani e Diritto dell’integrazione nella Università di Buenos Aires, ove è anche titolare della cattedra Jean Monnet di Diritto dell’Unione europea. È coordinatore del Seminario internazionale di Diritto costituzionale transnazionale.

Il volume affronta la grande e vasta tematica dei Diritti Umani, e lo fa attraverso contributi originali e trasversali di professionisti che si occupano della questione in diversi ambiti di studio e professionali. Le imprese multinazionali, strutture complesse, articolate in enti giuridici autonomi distribuiti nei differenti Stati in cui sono localizzate le fasi del processo produttivo, sono protagoniste dell’economia contemporanea e attrici della scena internazionale. Grazie al proprio potere economico, esse sono in grado di assumere un ruolo determinante sul piano internazionale, ponendosi come motori della crescita economica non solo dei Paesi esportatori di capitali, ma anche degli Stati ospiti. Nei numerosi casi oggetto del presente volume le imprese multinazionali si sono, tuttavia, segnalate anche per avere causato gravi violazioni dei diritti umani e massicci danni ambientali nei Paesi di operatività. La prospettiva dalla quale il volume esamina la problematica in oggetto è duplice, sia con riguardo al profilo di indagine adottato – quello del diritto internazionale pubblico e privato – sia con riferimento all’oggetto dell’analisi. Lo stato di avanzamento del diritto internazionale in questa materia è infatti esaminato avendo cura di prendere in considerazione tanto il ruolo rivestito dagli Stati, quanto i processi di responsabilizzazione attuati dalle imprese. Le due linee di ricerca sono fortemente compenetrate: la responsabilizzazione delle imprese multinazionali sul piano internazionale, improntata al rispetto di principi già esistenti nel diritto internazionale, è, secondo l’autrice, l’effetto congiunto di un movimento generato dagli Stati e dalla comunità internazionale nel proprio complesso e il risultato di una serie di tendenze espresse dagli operatori economici stessi. L’esame si sviluppa in tre sezioni, rispettivamente dedicate all’analisi degli obblighi internazionali gravanti sugli Stati, della corporate responsibility, della corporate accountability e della regolamentazione contrattuale di alcune attività in conformità con il diritto internazionale.

This book centres on the ways in which the concept of imperativeness has found expression in private international law (PIL) and discusses “imperative norms”, and “imperativeness” as their intrinsic quality, examining the rules or principles that protect fundamental interests and/or the values of a state so as to require their application at any cost and without exceptions. Discussing imperative norms in PIL means referring to international public policy and overriding mandatory rules: in this book the origins, content, scope and effects of both these forms of imperativeness are analyzed in depth. This is a subject deserving further study, considering that very divergent opinions are still emerging within academia and case law regarding the differences between international public policy and overriding mandatory rules as well as with regard to their way of functioning. By using an approach mainly based on an analysis of the case law of the CJEU and of the courts of the various European countries, the book delves into the origin of imperativeness since Roman law, explains how imperative norms have evolved in the different conceptions of private international law, and clarifies the foundation of the differences between international public policy and overriding mandatory rules and how these concepts are used in EU Regulations on PIL (and in the practice related to these sources of law). Finally, the work discusses the influence of EU and public international law sources on the concept of imperativeness within the legal systems of European countries and whether a minimum content of imperativeness – mainly aimed at ensuring the protection of fundamental human rights in transnational relationships – between these countries has emerged. The book will prove an essential tool for academics with an interest in the analysis of these general concepts and practitioners having to deal with the functioning of imperative norms in litigation cases and in the drafting of international contracts. The book gives insight into the structures and developments of the fundamental rights protection in Europe which is effective at the levels of the national Constitutions, the European Convention of Human Rights and, for the EU member States of the EU Fundamental Rights Charter. The contributions of renowned academics from various European countries demonstrate the functional interconnection of these protection systems which result in an increasing convergence. Basic questions are reflected, such as human dignity as foundation of fundamental rights or positive action as a specific form of equality as well as the concept of rights convergence. In this latter contribution the forms of direct reception of a different legal order and of the functional transfer of principles and concepts are analyzed. Particular reference is made to the EU Charter, the United Kingdom Human Rights Act as well as to France and Germany. It becomes obvious how important interpretation is for the harmonization of national and conventional fundamental rights protection. Traditional institutional approaches like the dualist transformation concept in Germany are functionally set aside in the harmonization process through constitutional interpretation. Specific studies are dedicated to the field of the EU Fundamental Rights Charter and to the European impacts on the national fundamental rights protection in selected countries such as the “new democracies” Poland, Romania and Kosovo as well as more traditional systems such as Spain, Italy, the Nordic countries or Turkey.
