This book explores the dynamic legal semantics of territory as applied to data. It offers a theoretical assessment of the legal challenges that data flows pose for the principle of territoriality and for state sovereignty more generally. The concept of sovereignty has traditionally developed in close connection with the exercise of powers over a territory, and ideas of jurisdiction have always been based on the principle of territoriality. Digitalization questions however the very idea of physical frontiers. Interconnected networks make data in effect borderless. Data can in fact be created, stored, processed, and accessed anytime and from anywhere. The idea of the book is upbeat: the law can keep pace with the ability of data to fragment reality. The condition for this is that sovereignty disconnects from territory. Disconnection is not getting rid of the territory once and for all, it only means that for data alternatives to the territorial connection exist. The analysis focuses on data from a holistic perspective (personal and nonpersonal) with the aim of investigating divergent and convergent solutions provided by different branches of the law (data protection, IP law, international law, and fundamental rights protection). It assesses in particular, the relationships between digitalization and the principle of territoriality, focusing on the specific legal aspects: the connections between law and territory; the impact of digitalization on state sovereignty; the use of extraterritoriality to circumvent territorial limitations on data flows; the rise of digital jurisdiction and its challenges; the interplay between digital jurisdiction and state sovereignty, and the alternative technological and legal solutions to data localization.

This book project studies the variation of sovereignty in international order by analysing how the general model of sovereignty is localised in the political practice of two major non-Western rising powers, namely China and India. It aims to investigate how the sovereignty of these states is constituted, which includes the question of how sovereignty works and becomes constituted in specific contexts and cases that fall outside the discourses and positions of the so-called Westphalian (conservative, absolutist) sovereignty that is dominantly advocated by these two states on a global level. The core of this project explores specific contested cases and situates them vis-à-vis the broader approaches of China and India to sovereignty. I specifically analyse four particular cases: China’s approach to sovereignty in relation to Hong Kong and Taiwan and India’s approach to sovereignty in relation to Bhutan and Kashmir. In doing so, I will illustrate that sovereignty is a flexible and plasticphenomenon which can be intertwined with principles, models or practices that are usually seen as divergent from or contradicting sovereignty; for example, those that derive from China’s and India’s imperial and colonial history.

The “interest contiguity theory,” which is the book’s centerpiece, holds that rather than a smooth, one-way cruise through history, humankind’s journey from the inception to the present has brought him/her face to face with broadly three types of interests. The first is the individual interest, which, strange as it may sound, tends to be internally contradictory. The second is society’s (or “national”) interest which, due to the clash of wills, is even more difficult than personal interest to harmonize. The third is the interest espoused to justify the establishment and maintenance of supranational institutions. Though conflicting, some interests are, due to their relative closeness (or contiguity), more easily reconcilable than others. In tracing the links between and among the three broad types of interests, the book begins with a brief philosophical discussion and then proceeds to examine the implications of human knowledge for individual liberty. Against the backdrop of the epistemological and ontological questions raised in the first chapter, the book examines the contending perspectives on the theory of the state, and in particular, the circumstances under which it is justified to place the interest of society over that of the individual. The focus of the fourth chapter is on the insertion of the supranational governance constant in the sovereignty equation, and on the conflict between idealist and realist, and between both and the Kantian explanations for the new order. The adequacy or otherwise of the conflicting explanations of the change from anarchy to a ‘new world order’ is the subject taken up in the succeeding chapters. Besides suggesting a new analytical tool for the study of politics and international relations, the contiguity theory offers statespersons new lenses with which to capture the seismic, perplexing and sometimes disconcerting changes unfolding before their eyes.
