After invading Tunisia in 1881, the French installed a protectorate in which they shared power with the Tunisian ruling dynasty and, due to the dynastyÕs treaties with other European powers, with some of their imperial rivals. This ÒindirectÓ form of colonization was intended to prevent the violent clashes marking FranceÕs outright annexation of neighboring Algeria. But as Mary Dewhurst Lewis shows in Divided Rule, FranceÕs method of governance in Tunisia actually created a whole new set of conflicts. In one of the most dynamic crossroads of the Mediterranean world, residents of TunisiaÑ whether Muslim, Jewish, or ChristianÑnavigated through the competing power structures to further their civil rights and individual interests and often thwarted the aims of the French state in the process. Over time, these everyday challenges to colonial authority led France to institute reforms that slowly undermined Tunisian sovereignty and replaced it with a more heavy-handed form of ruleÑa move also intended to ward off France's European rivals, who still sought influence in Tunisia. In so doing, the French inadvertently encouraged a powerful backlash with major historical consequences, as Tunisians developed one of the earliest and most successful nationalist movements in the French empire. Based on archival research in four countries, Lewis uncovers important links between international power politics and everyday matters of rights, identity, and resistance to colonial authority, while re-interpreting the whole arc of French rule in Tunisia from the 1880s to the mid-20th century. This book examines the structure of the rule on restrictive agreements in the context of vertical intra-brand price and territorial restraints, analysing, comparing and evaluating their treatment in US antitrust and EU competition law. It examines the concept of 'agreement' as the threshold question of the rule on restrictive agreements, the structure and focus of antitrust/competition law analysis, the treatment of vertical intra-brand price and territorial restrictions and their place in the test of antitrust/competition law. The treatment of vertical intra-brand restraints is one of the most controversial issues of contemporary competition law and policy, and there are substantial differences between the world's two leading regimes in this regard. In the US, resale price fixing merits an effects-analysis, while in the EU it is prohibited almost outright. Likewise, territorial protection is treated laxly in the US, while in the EU absolute territorial protection - due to the single market imperative - is strictly prohibited. Using a novel approach of legal analysis, this book will be of interest to academics and scholars of business and commercial law, international and comparative law.

Divided government occurs when the executive fails to enjoy majority support in at least one working house of the legislature. To date, the study of divided government has focused almost exclusively on the United States. However, divided government occurs much more widely. It occurs in other presidential systems. Moreover, it is also the equivalent of minority government in parliamentary regimes and cohabitation in French-style semi-presidential systems. This book examines the frequency, causes and management of divided government in comparative context, identifying the similarities and differences between the various experiences of this increasingly frequent form of government. Power sharing may be broadly defined as any set of arrangements that prevents one political agency or collective from monopolizing power, whether temporarily or permanently. Ideally, such measures promote inclusiveness or at least the coexistence of divergent cultures within a state. In places deeply divided by national, ethnic, linguistic, or religious conflict, power sharing is the standard prescription for reconciling antagonistic groups, particularly where genocide, expulsion, or coerced assimilation threaten the lives and rights of minority peoples. In recent history, the success record of this measure is mixed.
