This book presents a sociological account on marital dissolution that engages and extends theorisations on individualisation and the contemporary organisation of personal relationships to discuss how the experience of divorce might not be all debilitating but on the contrary, could provide opportunities for productivity, self-responsibility and relationship formation. Using Singaporean divorcees’ narrative accounts, the book explores how divorcees shape and construct what the author refers to as, a divorce biography, to end their unsatisfying marriages, cope with the crisis, negotiate the associated risks, organise post-divorce personal communities and make future plans. It uncovers how divorcees navigate their divorce biographies within the economic, policy and social context they are located in and examines the conditions that facilitate or hinder the pursuit of productivity in different facets of their post-divorce lives. Far from a standard story of divorce, this book presents the diversity and complexity of Singaporean divorce biographies. The research challenges negative discourses associated with divorce and offers a more nuanced perspective by discussing both the precarious and productive aspects of the experience. More importantly, it provides a critical discussion on the limited definition of family prevalent in Singaporean society, and shows how post-divorce family life and practices continue to thrive despite the rupture of marriage.

Several jurisdictions have attempted to render divorce more harmonious by abolishing matrimonial 'fault' and facilitating the resolution of divorce disputes by mediation. In Britain, these provisions appear in the Family Law Act 1996. The book presents a challenge to the underlying assumptions that conflict and the adversarial system are undesirable. Its focus is on adults’ experiences of divorce. In a series of interviews, divorcing people told their own stories of divorce. The personal narratives revealed that divorce can be emotionally traumatic, but it has positive sides too. The emotions of divorce are not pathological , but are readily explicable as ordinary human coping strategies , in the context of the real material privations that many divorcing people suffer. These coping strategies often involve conflict and acrimony. From a psychodynamic perspective, it is argued that these are integral, and psychologically necessary, aspects of the divorce process. This book is particularly topical in the light of the recent decision of the British Government to postpone the implementation of the Family Law Act 1996 and the acknowledged need for research to inform policy.

This book examines the (in)visibility of romantic love in the legal discourse surrounding modern Australian marriage. It looks at how romantic love has become a core part of modernity, and a dominant part of the Western marriage discourse, and considers how the ideologies of romantic love are (or are not) replicated in the legal meaning of marriage. This examination raises two key issues. If love has become central to people’s understanding of marriage, then it is important for the legitimacy of law that love is reflected in both the content and application of the law. More fundamentally, it requires us to reconsider how we understand law, and to ask whether it is engaged with emotions, or separate from them. In 1986 a national opinion poll indicated that over half of Irish voters favored an upcoming referendum to remove the constitutional ban on divorce. Yet, after nine weeks of vigorous debate during which forces on both sides of the issue presented their cases to the public, the amendment was defeated. In Debating Divorce, Michele Dillon uses the divorce referendum debate in Ireland as a base from which to explore the long-standing sociological preoccupation with how societies decide questions of values. Focusing on culture and moral conflict, she examines the stances adopted by the major players in the debate: the government and the political parties, the Catholic church, women, the print and broadcast media, and activists,on both sides. Although the issues of moral conflict that Dillon discusses have special relevance in demarcating Irish cultural values, they also apply to how people in general reason about morals and values. The author highlights the nature of moral discourse, the use of contradictory arguments in moral reasoning, the difficulty of trying to shift moral paradigms during non-revolutionary times, and the impossibility of keeping facts and values distinct as people grapple with conflicting moral claims. Examining the divorce question within historical themes of economic insecurity and Catholic identity, Dillon argues that the discourses articulated during the debate illustrate a universal tension between the forces of tradition and those of modernity. She dissects Irish opposition to divorce in terms of current challenges to rationality and its association with progress and goodness. This book examines gender, state and social power in Indonesia, focusing in particular on state regulation of divorce from 1965 to 2005 and its impact on women. Indonesia experienced high divorce rates in the 1950s and 1960s, followed by a remarkable decline. Already falling divorce rates were reinforced by the 1974 Marriage Law, which for the first time regulated marriage for both Muslim and non-Muslim Indonesians and restricted access to divorce. This law defined the roles of men and women in Indonesian society, vesting household leadership with husbands and the management of the household with wives. Drawing on a wide selection of primary sources, including court records, legal codes, newspaper reports, fiction, interviews and case studies, this book provides a detailed historical account of this period of important social change, exploring fully the impact and operation of state regulation of divorce, including the New Order government’s aims in enacting this legal framework, its effects in practice and how it was utilised by citizens (both men and women) to advance their own agendas. It argues that the Marriage Law was a tool of social control enacted by the New Order government in response to the social upheaval and protests experienced in the mid 1970s. However, it also shows that state power was not hegemonic: it was both contested and co-opted by citizens, with men and women enjoying different degrees of autonomy from the state. This book explores all of these issues, providing important insights on the nature of the New Order regime, social power and gender relations, both during the years of its rule and since its collapse.
