This edition differs from its predecessors in that, at the request of many French-speaking and other jurists, it is now completely bilingual, in the two official languages of the International Court of Justice under Article 39 of the Statute -- English and French. As before, this compilation aims to provide the practitioner in the Court, the diplomat, the politician and the student with a handy and complete collection of documents relating to the operation of the International Court of Justice, the principal judicial organ of the United Nations. In order to increase the usefulness of this compilation, the unofficial translations of the Rules of Court of 1978 into Arabic, Chinese, Russian and Spanish -- the official languages of the United Nations -- have been included.

In this book, the history and work of the International Court of Justice is commemorated. Its past and future roles are examined from various angles, which have been defined as "roles" played by the Court. The book illustrates the Court's role as a mechanism for the settlement of disputes, as well as its supervisory role, or, in other words, its possible role as the 'Supreme Court' in international law. Along with the presentation of documents and materials, its advisory function is also examined. The book concludes with a discussion of landmark cases by the Court.

Excerpt from The Status of the International Court of Justice: With an Appendix of Addresses and Official Documents "As is well known, the American delegation to the Second Peace Conference was directed by Mr. Root, as Secretary of State, to present a proposal for an International Court of Justice. Germany and Great Britain approved the plan and a joint project of the three nations was laid before the Conference. France, although not technically a party, warmly supported the idea. A draft convention concerning the Court, which by this time was known as the Court of Arbitral Justice, was adopted by the Conference and its establishment recommended through diplomatic channels. "It seems to the officers of the American Society for Judicial Settlement of International Disputes that the time has come for a somewhat elaborate account of the present status of the proposal, so that the partisans of judicial settlement shall be informed not only as to the original proposition, but as to the steps which have been taken to realize it. Documents too long for quotation in the article have been included in an appendix, which will, it is hoped, be found a useful supplement to the statements contained in the text and place before the reader the material necessary for a correct understanding of the draft convention adopted by the Second Conference, and the process by which that fortunate result was reached." Such was the preface to the tractate published but a few weeks (to be accurate, in the month of July) before the outbreak of the great war in August 1914. Evidence Before The International Court Of Justice written by Anna Riddell and has been published by British Institute for International & Comparative Law this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009 with Civil procedure (International law) categories.

Some recent contentious issues about the use of evidence in cases before the International Court of Justice have highlighted the importance of fact-finding and the use of evidence before this Court. This major study on the issue of evidence before the International Court of Justice has examined all aspects of the Court's relationship with facts - in both contentious and advisory proceedings - from the recently refined procedure for submitting late evidence, to the hearing of live witness testimony in the Peace Palace. Considerations of flexibility and respect for the sovereignty of the State Parties before the Court have traditionally deterred the Court from constructing concrete rules on matters of evidence, but the increasing numbers of cases, in which a thorough consideration of the facts has been essential, has highlighted that some detailed procedural guidance is necessary in order to ensure a well-functioning system of adjudication. It is apparent that the Court has paid an increasing amount of attention to its evidentiary proceedings as a result, often encountering difficulties in the inherent tensions between the common and civil law traditions and thus a divergence of opinions on the Bench. This book examines the history and development of the treatment of evidence, including the early days of the Permanent Court of International Justice - the predecessor of the International Court of Justice - up to the recent Nicaragua v Honduras judgment, critically analyzing the Statute and Rules of the Court, dicta from judgments and separate and dissenting opinions, the newly developed Practice Directions, and academic writings on the subject. The book not only provides an academic discussion of the subject, but also acts as a guide to practitioners appearing before the Court.
