Structures and processes occurring within and between states are no longer the only – or even the most important - determinants of those political, economic and social developments and dynamics that shape the modern world. Many issues, including the environment, health, crime, drugs, migration and terrorism, can no longer be contained within national boundaries. As a result, it is not always possible to identify the loci for authority and legitimacy, and the role of governments has been called into question. Civil Society anf International Governance critically analyses the increasing impact of nongovernmental organisations and civil society on global and regional governance. Written from the standpoint of advocates of civil society and addressing the role of civil society in relation to the UN, the IMF, the G8 and the WTO, this volume assess the role of various non-state actors from three perspectives: theoretical aspects, civil society interaction with the European Union and civil society and regional governance outside Europe, specifically Africa, East Asia and the Middle East. The interest in minority protection emerged during the period of democratic transition, particularly of ethnically segmented postcommunist societies after the end of the Cold War. Minority issues became prominent as postcommunist states lined up as potential candidates for EU membership and the respect for and protection of minority rights was an essential part of criteria these states had to fulfil before EU accession. Minority rights protection has constituted an important ‘gatekeeping’ criterion for EU membership. Its monitoring remains a powerful instrument to mediate tensions and to adjudicate discriminations in the present-day Europe. In many countries, minority rights standards have been transposed in domestic legislation, but whether these norms constitute a legitimate background which states accept, sustain and promote is the focus of this book. This volume takes on the task of analysing the diffusion of minority rights norms across the European continent. It looks specifically at the oft-neglected process of compliance meaning not only the formal adoption of European laws but also their implementation within the domestic context. This Commentary provides the reader with a review of international standards and practice relating to the political participation of minorities. Political participation has been increasingly recognized as a foundational issue in the debate about minority rights. It is argued that minorities are more likely to feel co-ownership in the state if they have the opportunity to participate freely and effectively in all aspects of its governance, and that sustained and meaningful engagement will guard against the sense of alienation and exclusion among minorities that often emerges in ethnically divided societies. Taking as its starting point the two most important standard-setting documents in the field - the Lund Recommendations on the Effective Participation of National Minorities in Public Life, developed by the Organization for Security and Cooperation in Europe, and the Council of Europe's Thematic Commentary on the Issue of Political Participation of Minorities - the Commentary locates the international legal entitlement to political participation within the wider context of the right to democratic governance. It also considers effective participation in relation to the right to full and effective equality, as well as the legal entrenchment of these provisions and implementation mechanisms. Individual chapters then consider each of the principal mechanisms aimed at enhancing political participation, ranging from procedures covering minority representation in political institutions to consultative mechanisms and autonomy solutions. The Commentary draws on a team of experts, all of whom are recognized authorities in this specialized area of minority issues.

Language constitutes a very sensitive nexus between the concepts of territory and community. Though a fundamental issue in contemporary societies, it remains relatively unaddressed by political scientists. This book promotes a better understanding of the connection between the concepts of identity, territory and language in the context of an enlarged Europe. We propose a portrait of the actual place of regional languages in European politics. Ethno-linguistic mobilisations have occurred in very different contexts, and their interpretation needs to take into account varying configurations and conditions of success that we label as situational, institutional, and socio-political. Globalization and European integration are sometimes seen as the enemies of nationalism, sweeping away particularisms and imposing a single economic, cultural and political order. The book argues on the contrary that, by challenging the 'nation-state' as the sole basis for identity and sovereignty, they open the way for a variety of claims by stateless nations. It is certainly true that recent years have seen a strong recurrence of nationalist claims, in Europe and in other parts of the world. At the same time, however, globalization and European integration provide new ways of managing nationality claims. At one level, they lower the stakes in independence and might permit peaceful transitions to independence. Yet they may also make independence in the traditional sense less important and provide ways in which multiple and conflicting nationality claims could be accommodated in new political structures. The chapters in this collection consider these issues from a theoretical perspective and through case studies of stateless nationalisms in western, eastern and central Europe, the former Soviet Union and Quebec. They record a wide variety of experiences and show that, while there are no easy answers to conflicting national claims, there is reason to believe that they can be managed through democratic political processes.
