It goes on to examine in depth the civil, political, economic, social and cultural rights and freedoms protected by the Declaration of Rights, analysing the relevant jurisprudence of the Namibian courts in the light of international human rights law.

An Introduction To Namibian Law written by S. K. Amor and has been published by African Books Collective this book supported file pdf, txt, epub, kindle and other format this book has been release on 2008-12-29 with Law categories.

The author of this book, Prof. S.K. Amor, is Acting Director of the Justice Training Centre and lecturer at the University of Namibia. The writing of this book was inspired mainly by the fact that, despite Namibia's independence in 1990, Namibian legal practitioners, academics and students lecturing and studying law at the University of Namibia (UNAM) still do not have a truly Namibian reference book. Instead, they rely heavily on legal literature from South Africa and other countries. An Introduction to Namibian Law is an attempt to bridge this gap by introducing law academics, lecturers and students to the most important aspects of Namibian law. It explains the origin of the country's law and looks at the various influences over the years. The book contains material covered in various UNAM courses, such as Jurisprudence, Introduction to Cases, Comparative Law, Constitutional and Administrative Law, Interpretation of Statutes, and Civil and Criminal Procedure. It also contains various extracts in support of legal arguments, in which legal concepts are illustrated and thoroughly explained, as well as sample legal forms. Full accounts of certain cases are included to give students of Namibian law a depth of understanding of how Namibian law has been applied over the years.

Constitutional Options For Namibia written by M. D. Bomani and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 1979 with Constitutional history categories.

This is the second study in a series published by the UN Institute of Namibia, designed to stimulate discussion on the constitutional options for an independent Namibia. It opens with a wide-ranging historical survey of the evolution of the constitutional structure imposed upon the territory by South Africa after 1920. The Turnhalle Constitutional Conference is then critically examined, and it is argued that its interim draft constitution was structured on the assumption of the continued existence of the bantustan ethnic homelands and racial segregation. The authors have deliberately refrained from making detailed proposals, leaving policy formulation to Namibians at a constitutional conference, but offer a sober discussion of the major policy options with regard to the functions of the executive, the legislature, the election process, the judiciary, citizenship, human rights, state succession, and the role of political parties. It does, however, come to the categorial conclusion that a unitary rather than a federal system of government is a necessity in order to transform the fragmented and ethnically based system. (Eriksen/Moorsom 1989).

"A Practical Guide to Constitution Building provides an essential foundation for understanding constitutions and constitution building. Full of world examples of ground-breaking agreements and innovative provisions adopted during processes of constitutional change, the Guide offers a wide range of examples of how constitutions develop and how their development can establish and entrench democratic values. Beyond comparative examples, the Guide contains in-depth analysis of key components of constitutions and the forces of change that shape them. The Guide analyzes the adoption of the substantive elements of a new constitution by looking at forces for the aggregation or dissemination of governmental power, and forces for greater legalization or politicization of governmental power, and examining how these forces influence the content of the constitution. It urges practitioners to look carefully at the forces at play within their individual contexts in order to better understand constitutional dynamics and play a role in shaping a constitution that will put into place a functioning democratic government and foster lasting peace."--
