El autor, catedrático de Derecho Penal de la Universidad Autónoma de México, mantiene una postura a favor de la legalización de las drogas como único camino para superar los graves problemas sociales que ocasiona el narcotráfico, promovidos por la prohibición misma. Para el autor, el problema de fondo no son las drogas en sí mismas, el problema es el tráfico ilícito, la violencia, los daños que se generan no como consecuencia de las sustancias, sino del contexto ilícito en que una decisión política obtusa las colocó. Lo que tiene que hacer el Estado, su responsabilidad, es evitar que la decisión voluntaria del consumo cause daños a terceros.

El 27 de agosto del 2012 el presidente de la República anunció que había llegado a un acuerdo con el movimiento guerrillero farc-epl para emprender negociaciones que condujeran a la terminación del conflicto armado. Las ne¬gociaciones han sido presentadas como el paso definitivo hacia una paz que favorecerá el progreso económico y el bienestar general, y han sido recibidas con grandes expectativas. No obstante, los discursos que anuncian la paz no son nuevos para el país, y los colombianos han perdido la ingenuidad cuan¬do se trata de las farc. Entre otras cosas, el público tiene una teoría sobre el conflicto, las negociaciones y la paz. Este libro participa en la construcción de esa teoría exigiendo que comprendamos que el derecho es una parte de la explicación de los acontecimientos en curso y que contribuye a esclarecer hacia dónde debemos dirigirnos —no pueden desatenderse las dimensiones jurídicas de la paz—; sin embargo, también sostiene que el derecho no debe entenderse como materialización de la verdad, la justicia o la moral, sino como un campo de batalla en que se enfrentan distintas visiones de la verdad, la justicia y la moral —las dimensiones políticas del derecho—. En particular, este libro proporciona elementos conceptuales pertinentes para los debates sobre el desarrollo rural, la participación política, el castigo, la política de drogas, el tratamiento de las víctimas, el papel del derecho internacional y los costos de la guerra y la paz.
