Handbook Of Human Dignity In Europe written by Paolo Becchi and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-05-08 with Law categories.

This handbook provides a systematic overview of the legal concept and the meaning of human dignity for each European state and the European Union. For each of these 43 countries and the EU, it scrutinizes three main aspects: the constitution, legislation, and application of law (court rulings). The book addresses and presents answers to important questions relating to the concept of human dignity. These questions include the following: What is the meaning of human dignity? What is the legal status of the respective human dignity norms? Are human dignity norms of a programmatic nature, or do they establish an individual right which can be invoked before court? Is human dignity inviolable? The volume answers these questions from the perspectives of all European countries. As a reaction to the barbaric events during World War II, human dignity (dignitas) found its way into international law. Article 1 of the Universal Declaration of Human Rights (UDHR) states that “[a]ll human beings are born free and equal in dignity and rights.” The starting point for developing the concept on a national level was the codification of human dignity in article 1, paragraph 1 of the German Grundgesetz. Consequently, the concept of human dignity spread throughout Europe and, in the context of human rights, became a fundamental legal concept.

How should political power be divided within and among national peoples? Is the nineteenth-century theory of the sovereign and unitary State still fit for purpose in the twenty-first century? If not, can federalism provide a viable alternative model? This collection looks at federalism from the perspective of constitutional law. Taking the United Kingdom as a case study, Part One tracks the historical evolution of the 'Union' and explores the various expressions of federalism that emerged between the eighteenth and twentieth centuries. Part Two then assesses the experience of sovereignty-sharing with other nations in the context of international cooperation. Drawing on the expertise of the foremost commentators in their field, The United Kingdom and the Federal Idea provides a timely and reflective evaluation of how constitutional authority is being re-ordered within and beyond the United Kingdom.

The Basque Country written by Paddy Woodworth and has been published by Andrews UK Limited this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012-01-10 with Travel categories.

The Basque Country is a land of fascinating paradoxes and enigmas. Home to one of Europe's oldest peoples and most mysterious languages, with a living folklore rich in archaic rituals and dances, it also boasts a dynamic post-modern energy, with the reinvention of Bilbao creating a model for the twenty-first-century city of cultural services and information technologies. Hugging the elbow of the Bay of Biscay on both the French and Spanish sides of the Pyrenees, this small territory abounds in big contrasts, ranging from moist green valleys to semi-desert badlands, from snowy sierras to sandy beaches, from harsh industrial landscapes to bucolic beech woods. This often idyllic scenery is the stage for fierce political passions. Almost every aspect of the Basque Country generates passionate disagreement, even its precise location. Spanish and French centralism, often authoritarian and sometimes brutal, has met with resistance for two centuries. Most recently and notoriously ETA, a terrorist group with deep popular support, has engaged in a bloody 45-year conflict. But many Basques consider themselves full French or Spanish citizens, and fear political and linguistic exclusion under Basque nationalist rule.

Law And Economics In Europe written by Klaus Mathis and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-11-11 with Law categories.

This anthology illustrates how law and economics is developing in Europe and what opportunities and problems – both in general and specific legal fields – are associated with this approach within the legal traditions of European countries. The first part illuminates the differences in the development and reception of the economic analysis of law in the American Common Law system and in the continental European Civil Law system. The second part focuses on the different ways of thinking of lawyers and economists, which clash in economic analysis of law. The third part is devoted to legal transplants, which often accompany the reception of law and economics from the United States. Finally, the fourth part focuses on the role economic analysis plays in the law of the European Union. This anthology with its 14 essays from young European legal scholars is an important milestone in establishing a European law and economics culture and tradition.
