This book provides a comparative analysis of Chinese property law as depicted in the newly enacted Chinese Civil Code. The Chinese Civil Code, the first civil code in the history of the People’s Republic of China, was enacted as law in May 2020. Reflecting the growing interest in this code and its provisions to scholars of codification and of comparative private law, it has already been translated into English, German, and Italian. Chinese property law has both local and global features, and this comparative study offers a channel through which to understand Chinese property law, by highlighting both its similarities and differences from other property systems. Broadly speaking, the book brings together two approaches. The first comprises a comprehensive discussion of aspects of Chinese property law, such as ownership, property rights, and secured transactions. The second consists of perspectives from other jurisdictions and provides an assessment of Chinese property law based on other property systems. Un exposé exhaustif, analytique et didactique Depuis le milieu des années 2000, la fonction publique vit une période de profondes transformations, lesquelles se sont multipliées très récemment. Cette nouvelle édition du " Précis " montre que la loi du 6 août 2019 dite de transformation de la fonction publique poursuit les recours aux contrats de recrutement en lieu et place des concours sur l'ensemble des versants de la fonction publique : État, collectivités locales, hôpitaux, statuts autonomes (agents des chambres consulaires et médecins hospitaliers). Elle modifie les déroulements des carrières des fonctionnaires désormais davantage individualisées et davantage dans les mains de la hiérarchie. Elle introduit la rupture conventionnelle du lien de fonction publique. Elle réduit le rôle des commissions administratives paritaires au profit de lignes directrices de gestion. Elle substitue les comités sociaux aux comités techniques et aux comités d'hygiène, de sécurité et des conditions de travail. Elle fait muer de nombreux emplois de direction en emplois fonctionnels. Une rupture apparemment majeure a aussi été prévue par cette loi de 2019, laquelle a renvoyé à une ordonnance du 17 février 2021 le soin de donner, pour la première fois dans notre histoire administrative, une valeur juridique aux accords administration-syndicats, lesquels n'étaient jusqu'à maintenant que des engagements moraux et politiques. Ces textes, et leurs nombreux décrets d'application, ouvrent une brèche significative dans la situation légale et règlementaire, statutaire des fonctionnaires. D'autres ordonnances consécutives ont fait progresser les droits sociaux des agents publics (ordonnances du 25 novembre 2020 et du 17 février 2021 relatives respectivement à la protection sociale et à la protection sociale complémentaire dans la fonction publique). Mais c'est la symbolique suppression de l'École nationale d'administration et sa transformation en un Institut national du service public (Ordonnance du 2 juin 2021 portant réforme de l'encadrement supérieur de la fonction publique de l'État) qui provoque une refonte peu statutaire de la condition des personnels de la haute fonction publique de l'État. Parce que rien n'est achevé, l'ouvrage montre qu'il ne faut pas conclure que le droit administratif de la fonction publique ne serait et ne sera plus statutaire. Les crises sanitaire et climatique semblent revivifier la nécessité du lien fonctionnaire/service public.

The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
