Who was Althusius, and why is the work of a seventeenth- century political theorist important in modern times? Johannes Althusius (1557-1638) was a political theorist and a combative city politician who defended the rights of small communities against territorial absolutism. He designed a system of politics in which sovereignty would be shared and jointly exercised by a plurality of collectivities, spatial as well as social, on the basis of mutual consent and social solidarity. Early Modern Concepts for a Late Modern World places Althusius in the context of his times and explains the main features of his political thought. It also suggests, perhaps most significantly, why his theories continue to resonate today. Hueglin’s use of sources is thorough and scrupulous. He has worked in depth in Germanic scholarship and this access to German-language sources, some of which are almost unknown to the English-speaking world, provides a new interpretation of Althusius’ theory. With its emphasis on pluralized governance, negotiated compromise instead of majority rule, and the inclusion of the economic sphere into the political, Althusius’ theory belongs to a countertradition in Western political thought. Although it was written at the beginning of the modern age of sovereign politics, it applies to today’s search for a post-sovereign system of politics.

Consociations are power-sharing arrangements, increasingly used to manage ethno-nationalist, ethno-linguistic, and ethno-religious conflicts. Current examples include Belgium, Bosnia, Northern Ireland, Burundi, and Iraq. Despite their growing popularity, they have begun to be challenged before human rights courts as being incompatible with human rights norms, particularly equality and non-discrimination. Courts and Consociations examines the use of power-sharing agreements, their legitimacy, and their compatibility with human rights law. Key questions include to what extent, if any, consociations conflict with the liberal individualist preferences of international human rights institutions, and to what extent consociational power-sharing may be justified to preserve peace and the integrity of political settlements. In three critical cases, the European Court of Human Rights has considered equality challenges to important consociational practices, twice in Belgium and then in Sejdic and Finci v Bosnia regarding the constitution established for Bosnia Herzegovina under the Dayton Agreement. The Court's decision in Sejdic and Finci has significantly altered the approach it previously took to judicial review of consociational arrangements in Belgium. This book accounts for this change and assess its implications. The problematic aspects of the current state of law are demonstrated. Future negotiators in places riven by potential or actual bloody ethnic conflicts may now have less flexibility in reaching a workable settlement, which may unintentionally contribute to sustaining such conflicts and make it more likely that negotiators will consider excluding regional and international courts from reviewing these political settlements. Providing a clear, accessible introduction to both the political use of power-sharing settlements and the human rights law on the issue, this book is an invaluable guide to all academics, students, and professionals engaged with transitional justice, peace agreements, and contemporary human rights law.

Classical Debates for the 21st Century distinctively reconsiders the canon of political thought, in the context of current world events, by presenting debates between the ideas of classical theorists. It is through these debates that Thomas O. Hueglin argues that exclusive state sovereignty, individual citizenship, and majority rule have become questionable categories of political theory and practice in a globalizing world. To a large extent, the classical canon of political thought has been constructed in order to give legitimacy to these categories, but it is time to rethink the validity of that canon, and to search for alternative voices and traditions that emphasize plurality, shared sovereignty, and complex patterns of representation and decision-making. This does not mean that the familiar names in the classical canon have to disappear. But they should be examined more critically for their continued importance, and additional theorists thus far neglected should complement them. Each chapteris organized as a debate between two theorists with contrasting views and approaches. At the end of each chapter, there is a critical evaluation of these political theorists’ continued or renewed relevance.

This book offers a multidisciplinary approach to the study of the concept of sovereignty. This book outlines the origins, context and evolution of the concept of sovereignty as an essential attribute of the modern territorial State since the Peace of Westphalia in 1648. The book identifies two competing traditions of the concept of sovereignty; the tradition inaugurated by Jean Bodin in 1576 in his work The Six Books of the Commonwealth and another that started with Johannes Althusius in 1603, considered the father of federal theory, in his less known work Politica. In order to understand the concept of sovereignty, it is necessary to understand the constitutional rules of each international system and the fact that the States are the primary polities in the international arena. The rise of International Organizations and the increasing institutionalization of the international system challenges this state-centric world, considering their exercise of sovereign powers. Following authors such as Daniel Elazar, the book discusses the importance of federalism as political theory, which offers a different understanding of the concept of sovereignty. The book discusses the European Union as a paradigmatic case of a postmodern confederation, which challenges the notion of sovereignty as an absolute and exclusive statehood attribute. Furthermore, the reconceptualization of sovereignty in International Law should consider the rise of regional and functional legal orders, the different understandings of sovereignty offered by the federalist tradition and the processes of deterritorialization and disaggregation of authority. This case study of the causes of the Thirty Years' War suggests an alternative framework to that of Absolutism, and views statebuilding as an interactive bargaining process that can engender challenges to political authority. It shows how selective court patronage changed the cultural habits of nobles in education, manners, and tastes, but failed to transform religious identities, which were intimately tied to noble interests. Instead, the confessionalization of patronage deepened divisions within the elite, providing multiple incentives for the formation of an anti-Habsburg alliance among Protestants in 1620.
