Immanuel Kant's legal philosophy and theory have played an enormous role in the development of law since the eighteenth century. Studienarbeit aus dem Jahr 2008 im Fachbereich Politik - Politische Theorie und Ideengeschichte, Note: 1,7, FernUniversität Hagen (Fakultät für Kultur- und Sozialwissenschaften), Veranstaltung: Philosophische Reflexion von Staat und Politik, Sprache: Deutsch, Abstract: Im folgenden Text setze ich mich mit der Frage auseinander, ob John Locke in seinen staatstheoretischen Schriften einen liberalen Rechtsstaat oder eine ökonomistische Freiheitslehre begründet. Hierfür verwende ich die hermeneutische Methode auf Basis eines historisch-analytischen Erkenntnisinteresses. Zu Lockes staatstheoretischen Schriften gab es bis heute schon verschiedene kritische Interpretationen, die voneinander unterschiedlicher nicht sein können. Zum Beispiel einerseits C.B. Macpherson mit seiner marxistisch orientierten Locke-Kritik, die dem Philosophen unterstellt, die Interessen der Unterschicht zu missachten. Andererseits Leo Strauss, welcher mit einer konservativen Locke-Interpretation, dessen utilitaristischen Individualismus, als Grund für die Zerstörung einer menschenwürdigen Ordnung bezeichnet. Diese Arbeit wird daher nicht den Charakter einer eindeutigen der Einordnung Lockes staatstheoretischer Schriften aufzeigen, sondern eine von vielen möglichen Einordnungen der politische Theorie dieses großen Philosophen darstellen. Hierfür ist es wichtig, das zuerst die Begriffe „liberaler Rechtsstaat“ und „ökonomistische Freiheitslehre“, wie sie in dieser Arbeit Anwendung finden sollen, definiert werden. Im Kapitel 3 erläutere ich die für diese Arbeit notwendigen Punkte der staatstheoretischen Lehre John Lockes. Zuerst wird John Lockes Auffassung vom Naturzustand beschrieben, welcher in zwei Phasen zu unterteilen ist. Zum Einen in den Naturzustand vor der Einführung des Geldes und zum Anderen in den Naturzustand nach der Einführung des Geldes. Hiernach wird der Begriff des Eigentums bei Locke dargelegt. Im dritten Unterpunkt findet das Kapitel 3 seinen Abschluss mit der Beschreibung der Staatsgründung aus dem Naturzustand. Die vergleichende Einordnung der im Kapitel 3 erarbeiteten staatstheoretischen Lehre Lockes in die Definition des liberalen Rechtsstaates folgt in Kapitel 4. Ebenso verfahre ich mit der Definition der ökonomistischen Freiheitslehre in Kapitel 5. Das Kapitel 6 dient der Ergebniszusammenfassung aus den Kapiteln 3 bis 5. Das Ende meiner Arbeit stellt mein persönliches Fazit aus diesen erkenntnisorientierten Vergleichen dar.

John Locke's theory of property is perhaps the most distinctive and the most influential aspect of his political theory. In this book James Tully uses an hermeneutical and analytical approach to offer a revolutionary revision of early modern theories of property, focusing particularly on that of Locke. Setting his analysis within the intellectual context of the seventeenth century, Professor Tully overturns the standard interpretations of Locke's theory, showing that it is not a justification of private property. Instead he shows it to be a theory of individual use rights within a framework of inclusive claim rights. He links Locke's conception of rights not merely to his ethical theory, but to the central arguments of his epistemology, and illuminates the way in which Locke's theory is tied to his metaphysical views of God and man, his theory of revolution and his account of a legitimate polity.
