This book explores how the law and the institutions of the criminal justice system expose minorities to different types of violence, either directly, through discrimination and harassment, or indirectly, by creating the conditions that make them vulnerable to violence from other groups of society. It draws on empirical insights across a broad array of communities and locales including Afghanistan, Colombia, Pakistan, India, Malawi, Turkey, Brazil, Singapore, Puerto Rico, and the Philippines. It examines the challenges of protecting those at the margins of power, especially those whom the law is often used to oppress. The chapters explore intersecting, marginal identities influenced by four factors: rebuilding after violent regimes, economic interest behind the violence, entrenched cultural biases, and criminalisation of diversity. Crime and violence soared in twenty-first-century Venezuela even as poverty and inequality decreased, contradicting the conventional wisdom that these are the underlying causes of violence. The Paradox of Violence in Venezuela explains the rise of violence under both Hugo Chávez and Nicolás Maduro—leftist presidents who made considerable investment in social programs and political inclusion. Contributors argue that violence arose not from the frustration of inequality, or the needs created by poverty, but rather from the interrelated factors of a particular type of revolutionary governance, extraordinary oil revenues, a reliance on militarized policing, and the persistence of concentrated disadvantage. These factors led to dramatic but unequal economic growth, massive institutional and social change, and dysfunctional criminal justice policies that destabilized illicit markets and social networks, leading to an increase in violent conflict resolution. En 2016, el Acuerdo de Paz entre el gobierno colombiano y las Fuerzas Armada Revolucionarias de Colombia Ejército del Pueblo (FARC EP) marcó el fin de la guerra con el grupo insurgente más poderoso y antiguo del continente. Pese a estos logros, el Acuerdo supone transformaciones institucionales y sociales de hondo calado, a través de un modelo de justicia Transicional inédito en el mundo, el cual, si las contingencias políticas no lo impiden, podría durar hasta 20 años. El presente documento recoge los resultados de cinco proyectos de investigación del grupo Derecho y Política, de la Facultad de Derecho, Ciencias Políticas y Relaciones Internacionales, de la Fundación Universitaria Los Libertadores. En ellos, el lector encontrará un análisis pormenorizados sobre los retos institucionales y sociales que impone el Acuerdo en su incipiente recorrido, como: la reincorporación de excombatientes; el análisis de contexto y la priorización como estrategias de la justicia transicional; la participación activa y directa de las víctimas del conflicto, en la jurisdicción Especial de Paz OEP); la articulación y coordinación entre la jEP y la jurisdicción Especial Indígena; y finalmente, el papel de la educación superior en la consolidación del Acuerdo.
