En esta obra se aborda con actualidad un tema tan controvertido como el alojamiento colaborativo, que en los últimos años ha venido suscitando un amplio y vivo debate. El alquiler de viviendas de uso turístico ha revolucionado el sector del alojamiento a lo que además hay que sumar el fenómeno de internet, lo cual ha generado problemas acuciantes como el encarecimiento de precios, la ausencia de oferta de vivienda para un arrendamiento tradicional, el colapso de infraestructuras públicas, la gentrificación de las ciudades y los problemas de competencia desleal con la hostelería tradicional y con la elusión de controles administrativos, entre otros. De ahí que resulte necesario conciliar los intereses de todas las partes afectadas, lo cual se complica desde el momento en que las competencias en materia de turismo han sido recogidas en los Estatutos de Autonomía, si bien es cierto que en su mayoría no tienen competencia para regular los aspectos jurídico privados de la relación que se establece entre arrendador y arrendatario. La descoordinación entre autonomías resulta más que evidente con la consecuente fragmentación del marco legal que trae consigo. Todo lo anterior ha planteado algunas cuestiones que se han ido abordando a lo largo de esta obra: el boom de las viviendas de uso turístico, el reparto competencial en el ámbito de las viviendas de uso turístico en España entre el Estado, las Comunidades Autónomas e incluso los Municipios que pueden aprobar normas que, directa o indirectamente, repercutan sobre estas viviendas, el arrendamiento de vivienda turística completa o por estancias, la modificación del art. 17 apartado 12 la Ley de Propiedad Horizontal, las plataformas digitales de alojamiento turístico, los fraudes en los alquileres turísticos ofertados en internet y el cohousing, todo ello acompañado de una visión socio económica que pone de manifiesto la escasez de datos que permitan tanto trazar una estrategia de oferta turística adecuada como ofrecer una fotografía de la situación nacional.

El progresivo e imparable éxito alcanzado en los últimos años por el alojamiento de corta estancia en viviendas particulares destinadas a un uso turístico ha provocado, sobre todo en ciudades con notable afluencia turística, un importante impacto social y económico que afecta directamente a los derechos e intereses de terceros ajenos a la relación contractual, y suscita graves enfrentamientos y litigios entre los profesionales del sector de alojamiento turístico, los propietarios de las viviendas cedidas en alquiler y las empresas que actúan como soporte de las plataformas de alojamiento colaborativo. La entidad de los derechos en conflicto (derecho a la vivienda, derecho a la libertad de empresa, derecho de propiedad, derecho al medioambiente…), si bien motiva que no sea fácil determinar la prevalencia de unos sobre otros, exige que cualquier limitación y restricción que se imponga a unos en favor de otros esté clara y objetivamente justificada. No ha sido este el camino seguido en nuestro ordenamiento jurídico en el que, so pretexto de defender el «interés general» y de luchar contra las «externalidades negativas», identificadas con la saturación de determinados espacios y servicios públicos, con la pérdida de identidad de las ciudades y con el alza de los precios de la vivienda en las áreas centrales, los legisladores han aprobado normas que exceden claramente de sus competencias y limitan en exceso el derecho individual de propiedad y el de libertad de empresa.

The interpretation of Hegel has been a focal point of philosophical controversy ever since the beginning of the twentieth century, both among Marxists and in the major European philosophical schools. Yet despite wide differences of emphasis most interpretations of Hegel share important similarities. They link his idea of Reason to the revolutionary and rationalist tradition which led to the French Revolution, and they interpret his dialectic as implying a latently atheist and even materialist world outlook. Lucio Colletti directly challenges this picture of Hegel. He argues that Hegel was an essentially Christian philosopher, and that his dialectic was explicitly anti-materialist in both intention and effect. In contrast to earlier views, Colletti maintains that there is no contradiction between Hegel’s method and his system, once it is accepted that his thought is an exercise in Absolute Idealism stemming from a long Christian humanist tradition. He claims, on the contrary, that intellectual inconsistency is rather to be found in the works of Engels, Lenin, Lukás, Kojève and others, who have attempted to adapt Hegel to their own philosophical priorities. Colletti places his argument in the context of a broad re-examination of the whole relationship between Marxism and the Enlightenment, giving novel emphasis to the relationship between Marxism and Kant. He concludes by re-asserting the importance in Marxism of empirical science against the claim of “infinite reason,” while at the same time showing how Marx did transform key ideas in Hegelian thought to construct a consistently materialist dialectic.
