This volume explores the interrelationship between ideology, the state and higher education reforms, setting it in a global context. Legal statements are, according to the authors, the most basic elements of the law. Nevertheless they must be considered not only as the pieces of a puzzle, but also as the components of a dynamic and highly complex reality: the law of contemporary society. The book presents an analysis of the different types of legal statements (mandatory rules, principles, power-conferring rules, definitions, permissions, values and the rule of recognition) from a threeefold perspective, that is, considering their logical structure, their function in legal reasoning as reasons for action, and their connections with the interests and power relationships among the individuals and the social groups. Existen problemas globales que no forman parte de la agenda política de los gobiernos nacionales, aunque de su solución dependa la supervivencia de la humanidad: el calentamiento global, las amenazas a la paz mundial, el crecimiento de las desigualdades, la muerte de millones de personas todos los años por falta de agua potable, de alimentación básica y de fármacos esenciales, o las masas de migrantes que huyen de las condiciones de miseria y degradación de sus países. Pero estas tragedias no son fenómenos naturales, ni tampoco simples injusticias. Por el contrario, son violaciones masivas de los derechos fundamentales estipulados en las diversas cartas constitucionales vigentes, tanto nacionales como supranacionales. La humanidad se encuentra hoy ante una encrucijada de la historia, seguramente la más dramática y decisiva: sufrir y sucumbir a las múltiples catástrofes y emergencias globales, o bien hacerles frente, oponiéndoles la construcción de idóneas garantías constitucionales a escala planetaria, proyectadas por la razón jurídica y política. Solo una Constitución de la Tierra que introduzca un demanio planetario para la tutela de los bienes vitales de la naturaleza, prohíba todas las armas como bienes ilícitos, comenzando por las nucleares, e introduzca un fisco e instituciones idóneas globales de garantía en defensa de los derechos de libertad y en actuación de los derechos sociales puede realizar el universalismo de los derechos humanos. El proyecto de una Constitución de la Tierra no es una hipótesis utópica, sino la única respuesta racional y realista capaz de limitar los poderes salvajes de los estados y los mercados en beneficio de la habitabilidad del planeta y de la supervivencia de la humanidad.
