Cualquiera que haya litigado suficientes casos de incuplimiento contractual, que haya dictado suficientes sentencias sentencias al respecto o quien las haya leído, podrá dar cuentta de lo siguientte : muy probablemente se demandará daño moral. Existe, por tanto, un número relevante de sentencias de la Corte Suprema que se hacen cargo del daño moral frente a incuplimientos contractuales. Por otra parte, aun cuando no haya sentencias de la Corte Suprema al respecto, habrá que tener presente que, a partir de la entrada en vigencia de la Ley N° 21.081, que modifica la Ley N° 19.496 sobre Protección de los Derechos de los Consumidores, el daño moral procede respecto de las acciones colectivas. De manera que un contratante que actúa como proveedor debería pensar qué consecuencias puede tener que se le obligue a indemnizar el daño moral a lo cientos de miles de consumidores que contrataron con él. El presente trabajo busca diagnosticcar el estado actual de la cuestión del daño moral frente a incuplimientos contractuales a través de distintos aspectos que plantea esta partida indemnizatoria. Tales cuestiones son la definición, procedencia, función, limitaciones, prueba y montos del daño moral. La respuesta a estos temas permitirá establecer cuál es el enfoque de la Corte Suprema al respecto. El propósito de este libro, entonces, consiste en dar cuenta del estado de las cosas. No es, por consiguiente, un libro ensayístico, sino más bien uno descriptivo.

The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
