La 4e de couverture indique : En el delito fiscal confluyen la actuación de la Administración tributaria y de la Jurisdicción penal. La articulación de esta confluencia plantea problemas de extraordinaria dificultad teórica y práctica, que han sido muy mal resueltos en España. El sistema español de persecución del delito fiscal, todavía vigente, pero, afortunadamente, ya herido de muerte, se impulsó reglamentariamente, al margen de la ley, con la pretensión de evitar la inevitable separación de los procedimientos sancionador y tributario, recibiendo su definitiva configuración de la jurisprudencia. El resultado es un sistema en el que el delito fiscal es una suerte de exención tributaria contra legem, pues los delincuentes fiscales no tienen que pagar cuota tributaria alguna, sino la responsabilidad civil derivada del delito. Y en el que la Administración debe paralizarse ante la defraudación tributaria, pues carece de competencias para su investigación. Al mismo tiempo, el contribuyente sobre el que pesan indicios de delito carece de los derechos que deberían corresponder al preimputado en el procedimiento inspector. Parece evidente que el delito fiscal no debe suponer privilegios tributarios para el delincuente, al mismo tiempo que el contribuyente debe disponer de los derechos que asisten a quien sufre una investigación por la presunta comisión de un delito. Ello exige que la Administración no se paralice ante el delito y que se regulen las especialidades procedimentales y organizativas necesarias para la investigación del delito fiscal, con sujeción a los principios propios de un Estado de Derecho. La reforma realizada por la LO 7/2012, de 27 de diciembre, pone de manifiesto esta necesidad, al mismo tiempo que la incapacidad del legislador español para atenderla.
