Con la incorporación del concepto de seguridad social en la Constitución Política de 1991 y, especialmente, con el establecimiento de los parámetros generales para la organización de la seguridad social en Colombia bajo la denominación legislativa de Sistema de Seguridad Social Integral, la sociedad colombiana no solamente se actualizó en el derecho positivo con respecto a algunos de los compromisos internacionales adquiridos por el Estado, sino que ha dado lugar a todo un desarrollo legislativo, reglamentario y de la jurisprudencia, para la construcción de un modelo de seguridad adecuado a las características de la sociedad colombiana; pues con el establecimiento del derecho a la seguridad social para todos los habitantes, llevado en buena hora por la jurisprudencia a la categoría de derecho fundamental, son muchos los avances que se pueden recaudar luego de dos décadas del proceso de implantación e implementación. De igual manera, la declaración del constituyente primario sobre el carácter de servicio público obligatorio, con todas las connotaciones otorgadas por la propia Carta, y la protección a los recursos de la seguridad social, son postulados que permiten presagiar un buen desarrollo de la disciplina de la seguridad social no solamente en su dimensión jurídica para el derecho de la seguridad social en plena construcción. La revisión que en este trabajo se hace de los fundamentos constitucionales de la seguridad social, dentro de marco del Estado social de derecho, adoptado por Colombia en 1991, debe permitir a estudiosos y profanos en el tema hacer aportes en vía de la incorporación de una cultura de la seguridad social autónoma y desligada de la protección meramente asistencial que por muchos años ha imperado en la sociedad colombiana.
