Dentro del ámbito del derecho internacional de las inversiones, esta obra busca analizar de manera crítica la evolución histórica del derecho sustancial aplicable para resolver las controversias internacionales de inversión. En especial, pretende ilustrar la forma en que los inversionistas han buscado "internacionalizar" el derecho sustancial aplicable, através de mecanismos tales como el estándar de nivel mínimo de trato, la protección diplomática, los contratos de Estado y, más recientemente, la firma de acuerdos internacionales de inversión [All] regidos por el derecho internacional y la interpretación arbitral del artículo 42 [1] de la Convención del CIADI. La obra muestra cuáles han sido, cuáles son y cuáles deberían ser las normas jurídicas que un tribunal arbitral internacional debería aplicar para resolver el fondo de una disputa entre un inversionista extranjero y el Estado colombiano. En el contexto de la lucha histórica entre la aplicación del derecho interno y la del derecho internacional. El presente trabajo, luego de revisar el derecho internacional consuetudinario, convencional y "jurisprudencial", propone acudir al artículo 38[1](c) del Estatuto de la Corte Internacional de Justicia para despertar a la "bella durmiente". A través del derecho internacional comparado y sin olvidar la naturaleza híbrida del arbitraje internacional de inversión, se propone entonces la aplicación de los principios generales del derecho reconocidos por las naciones civilizadas, ya no para "internacionalizar" el régimen jurídico aplicable sino como puente para "domesticarlo", retornando a la famosa doctrina Calvo. En particular, la obra propone, para juzgar la conducta estatal en el arbitraje de inversión, utilizar aquellos principios desarrollados por el derecho público interno de los principales sistemas jurídicos del mundo.

The Ultimate Rule of Law addresses the age-old tension between law and politics by examining whether the personal beliefs of judges come into play in adjudicating on issues of religious freedom, sex discrimination, and social and economic rights. Decisions by the Supreme Courts of India, Japan, Canada, the United States, Ireland, Israel, the Constitutional Courts of Germany, Hungary, South Africa, and the European Court of Human Rights on such controversial issues as government funding of religious schools, abortion, same sex marriages, women in the military, and rights to basic shelter and life saving medical treatment are evaluated and compared. Beatty develops a radical alternative to the conventional view that in deciding these cases judges engage in an essentially interpretative, and thus subjective act, relying ultimately on their personal beliefs and political opinions. His analysis shows that it is possible to apply an impartial and objective method of judicial review, based on the principle of proportionality, which acts as an ultimate rule of law and is fully compatible with the ideals of democracy and popular sovereignty. Controversially, Beatty concludes that although this method of judicial review originated in the United States, American judges generally appear to be far less inclined to this conception of constitutional adjudication than their counterparts in Europe, Africa, and Asia.
