"El derecho canónico se concibe a menudo como el conjunto de leyes eclesiásticas y, en consecuencia, su estudio se entiende como una actividad que consiste en memorizar cánones. Se reconoce la utilidad de estas normas para establecer la necesaria disciplina eclesiástica, pero se teme que puedan reducir la libertad de los fieles, aprisionar la vida eclesial en rígidos esquemas organizativos, oponerse al dinamismo pastoral y llegar a negar la práctica de la misericordia. Al mismo tiempo, el momento actual muestra la necesidad de que la Iglesia disponga de medios para prevenir y remediar los diversos escándalos que la asolan. De este modo el derecho canónico se acepta como un mal menor. Este libro pretende ofrecer una visión distinta del derecho en la Iglesia: su estudio no versa sobre la ley eclesiástica, sino sobre lo que es justo en la Iglesia. Partiendo de este postulado, el estudio del derecho canónico se concibe como la iusti atque iniusti scientia en la Iglesia. La presente obra no pretende, por tanto, exponer las normas vigentes, sino proponer las nociones jurídicas fundamentales que permitan comprender las exigencias primarias de justicia que existen en la vida de la Iglesia. Para ello, se estudian las realidades de la Iglesia (personas, instituciones, asociaciones) bajo el aspecto de la justicia. El propósito de este libro es introducir al estudio del derecho canónico mediante la reflexión sobre la dimensión de justicia inherente a las relaciones intraeclesiales, sin pretender agotar una parte específica de la ciencia canónica. Lo justo en la Iglesia es hoy una noción clave que permite respetar a las personas y a los carismas, otorgando a cada uno de los fieles sus derechos. El texto aborda algunos temas básicos como la naturaleza del derecho en la Iglesia, su historia, las relaciones entre la Iglesia y la sociedad civil, los principios jurídicos constitucionales de la Iglesia, los derechos y deberes fundamentales de los fieles, la dimensión jurídica del fenómeno asociativo en la Iglesia, el estatuto jurídico de los ministros sagrados, los perfiles jurídicos de la vida consagrada y el gobierno justo en la Iglesia.
