La acción educativa está íntimamente relacionada con la transmisión de contenidos, competencias y valores tiendo como objetivo primordial el desarrollo del alumnado y su preparación para su integración en el entorno social que le rodea. Se trata de un hecho innato a la vida misma y se caracteriza por dos notas fundamentales, su universalidad y su temporalidad. La temporalidad de este fenómeno social emana de múltiples factores que engloban lo que conocemos como contexto educativo y que brotan de su propia historia. La escuela nace en un contexto educativo muy concreto, caracterizado por las exigencias de un nuevo tipo de sociedad: el orden social instaurado tras la primera Revolución Industrial que necesitaba de un instrumento capaz para transmitir una nueva cultura del trabajo y de los nuevos modelos de vida insaturados por aquel entonces. La necesidad de adaptarse a la vida en el ámbito industrial, a los nuevos ritmos de vida, a las nuevas formas de trabajo y a otros elementos de nuevo cuño que mediatizaron la vida de las personas a partir de ese momento como, por ejemplo, el uso generalizado del reloj, convirtieron a la escuela en el agente más eficaz para el desarrollo de la sociedad. En el devenir de los tiempos la acción educativa ha sido capaz de adaptarse a las estructuras sociales contemporáneas de cada momento histórico dado. Así, las escuelas lejos de ceñirse a ser una mera institución de transmisión de conocimientos, constituyen lugares que representan formas de conocimiento, usos lingüísticos, relaciones sociales y valores que implican selecciones y exclusiones particulares a partir de la cultura general. Como tal, los centros docentes sirven para producir y legitimar las formas particulares de vida social, de cada momento histórico dado. Un claro ejemplo de ello es el contexto educativo español contemporáneo, que se ha adaptado a las profundas transformaciones sociales que han tenido lugar en nuestro país, como consecuencia de dos factores diferenciados, pero, a su vez, convergentes en este ámbito en el que están formándose las nuevas generaciones de alumnos que conforman el presente y el futuro de las estructuras sociales contemporáneas del país: la diversidad religiosa y cultural y los vertiginosos avances que se están produciendo en relación con las tecnologías de la sociedad de la información y del conocimiento en plena Era Digital. Sobre la base de ambos presupuestos, en la presente se ha abordado los retos del derecho fundamental del menor a ser educado conforme a su propia conciencia en una sociedad cada vez más plural y tecnológicamente avanzada, como es la sociedad española contemporánea. SALVADOR PÉREZ es Licenciado en Derecho por la UCM en julio de 2000 con nota media de sobresaliente y Doctor en Derecho por la UNED en junio de 2005 que obtuvo el premio extraordinario de la Facultad de Derecho de la UNED del Curso Académico 2005/2006 Tras ocupar varios puestos docentes en 2012 fue acreditado como Profesor Titular de Universidad, puesto que ocupa desde marzo de 2018. Imparte docencia en primer y segundo ciclo de la Facultad de Derecho de la UNED desde 2001; en estudios de Tercer Ciclo en diferentes Programas de Máster y Doctorado de la Facultad de Derecho de la UNED y en varios Cursos de Formación Permanente desde 2006 algunos de los cuales ha dirigido personalmente. La calidad de su incipiente labor docente queda avalada mediante el reconocimiento positivo de tres Quinquenios hasta la actualidad. Sus líneas de investigación más notables son: 1) Libertad de conciencia y derecho a contraer matrimonio; 2) Libertad de conciencia, diversidad y Bioderecho; 3) Diversidad y pluralismo cultural y minorías; 4) Derechos fundamentales de los menores e internet; y 5) Derecho, interculturalidad y Ciberespacio; y 6) Libertad de conciencia y derecho a la educación. Los resultados de estos estudios se han visto plasmados en una obra monográfica, en varias obras colectivas y en colaboraciones y artículos científicos publicados en obras colectivas y revistas científicas de reconocido prestigio nacional e internacional; cuya calidad queda avalada por el reconocimiento, hasta el momento, de dos Sexenios por la CNEAI.
