El deterioro, a gran escala, de la Naturaleza hoy, en buena medida causado por comportamientos y malos usos del hombre, es una evidencia que obliga a que ésa se defienda y modifique sus propios cauces como, por ejemplo, los que han llevado al cambio climático que estamos ya viviendo. También se ha despertado cierta conciencia hacia el respeto de la misma. No hay más que echar un vistazo a los importantes y diversos movimientos de carácter ecologista que han impulsado, con diferente éxito, a que los poderes políticos actúen y pongan en marcha diversidad de disposiciones en aras de la conservación del medio ambiente.La cuestión a la que este libro, en concretos aspectos jurídicos, pretende dar respuesta, centra su observación histórica sobre el ejercicio de conductas ‘buenas’ y ‘malas’ del hombre con relación a los medios de subsistencia que le proporcionaba la obra de Dios, su entorno natural del que es inseparable, al que de ordinario no vulnera y al que solamente se enfrenta en situaciones excepcionales.Las diversas aportaciones que componen esta obra ponen de manifiesto la reacción del Derecho frente a la relación del hombre con la tierra dentro del espacio temporal que abarca el tránsito de la Edad Media a la Edad Moderna (siglos XI-XVI). Este período, considerado coincidente con el esplendor del derecho común, ofreció a los autores la peculiaridad de analizar, dentro del sistema del ius commune, los derechos propios y el derecho común, tanto por lo que se refiere al ius civile, como al ius canonico en los temas específicos tratados. Nos brindó también la posibilidad de estudiar cómo el derecho reacciona ante los problemas de la Naturaleza propios del Nuevo Mundo (Las Indias, Ultramar), incorporado a la Corona de Castilla en el siglo XVI y que, por sus diversas condiciones geográficas y ambientales, resultaron ser diferentes a los del Viejo Mundo.
