En el ámbito del hate speech se crea una tensión insoslayable —y necesaria— entre la libertad de expresión como autonomía individual y la igualdad como no sometimiento, entendida como la no constitución o mantenimiento de grupos subordinados en la sociedad. Los desarrollos teóricos para tratar esta tensión son insuficientes y ambiguos y arrojan como "soluciones" encarar falsos dilemas y sacrificios inaceptables entre la igualdad o la libertad. La inquietud sobre la posible falta de protección de miembros de estos grupos ante discursos de odio o intolerantes y su abordaje en el marco de las garantías a la libertad de expresión motiva la elaboración de este trabajo. Luego de analizar modelos referenciales en la materia, junto a diversos aportes doctrinarios, se plantea desde el liberalismo igualitario una teoría regional de la libertad de expresión con énfasis en el discurso de odio y el discurso intolerante que armonice la relación de nuestros valores más preciados de la democracia liberal y cristalice en una propuesta de ley modelo interamericana contra el discurso de odio. RICARDO F. ROSALES ROA es abogado egresado de la UCAB (Caracas, Venezuela). Magister en Derecho Internacional de los Derechos Humanos por la UBA (Buenos Aires, Argentina), con tesis calificada como "sobresaliente con mención especial". Actualmente es becario completo del Master en Estudios de Desarrollo por el IHEID (Ginebra, Suiza). Se desempeña como Consultor Jurídico de la ONG Espacio Público (Caracas), así como Investigador de la ONG AlertaVenezuela (Bogotá, Colombia). While there are differences between cultures in different places and times, colonial representations of indigenous peoples generally suggest they are not capable of literature nor are they worthy of being represented as nations. Colonial representations of indigenous people continue on into the independence era and can still be detected in our time. The thesis of this book is that there are various ways to decolonize the representation of Amerindian peoples. Each chapter has its own decolonial thesis which it then resolves. Chapter 1 proves that there is coloniality in contemporary scholarship and argues that word choices can be improved to decolonize the way we describe the first Americans. Chapter 2 argues that literature in Latin American begins before 1492 and shows the long arc of Mayan expression, taking the Popol Wuj as a case study. Chapter 3 demonstrates how colonialist discourse is reinforced by a dualist rhetorical ploy of ignorance and arrogance in a Renaissance historical chronicle, Agustin de Zárate's Historia del descubrimiento y conquista del Perú. Chapter 4 shows how by inverting the Renaissance dualist configuration of civilization and barbarian, the Nahua (Aztecs) who were formerly considered barbarian can be "civilized" within Spanish norms. This is done by modeling the categories of civilization discussed at length by the Friar Bartolomé de las Casas as a template that can serve to evaluate Nahua civil society as encapsulated by the historiography of Fernando de Alva Ixtlilxochitl, a possibility that would have been available to Spaniards during that time. Chapter 5 maintains that the colonialities of the pre-Independence era survive, but that Criollo-indigenous dialogue is capable of excavating their roots to extirpate them. By comparing the discussions of the hacienda system by the Peruvian essayist Manuel González Prada and by the Mayan-Quiché eye-witness to history Rigoberta Menchú, this books shows that there is common ground between their viewpoints despite the different genres in which their work appears and despite the different countries and the eight decades that separated them, suggesting a universality to the problem of the hacienda which can be dissected. This book models five different decolonizing methods to extricate from the continuities of coloniality both indigenous writing and the representation of indigenous peoples by learned elites.

Available in English for the first time, An Inca Account of the Conquest of Peru is a firsthand account of the Spanish invasion, narrated in 1570 by Diego de Castro Titu Cusi Yupanqui - the penultimate ruler of the Inca dynasty - to a Spanish missionary and transcribed by a mestizo assistant. The resulting hybrid document offers an Inca perspective on the Spanish conquest of Peru, filtered through the monk and his scribe. Titu Cusi tells of his father's maltreatment at the hands of the conquerors; his father's ensuing military campaigns, withdrawal, and murder; and his own succession as ruler. Although he continued to resist Spanish attempts at "pacification," Titu Cusi entertained Spanish missionaries, converted to Christianity, and then, most importantly, narrated his story of the conquest to enlighten Emperor Phillip II about the behavior of the emperor's subjects in Peru. This vivid narrative illuminates the Incan view of the Spanish invaders and offers an important account of indigenous resistance, accommodation, change, and survival in the face of the European conquest. Natalia Sierra nos convoca a una lectura distinta de luchas emancipatorias surgidas en los últimos años en América Latina: México con el movimiento Yo soy 132 (2012) y por los 43 estudiantes desaparecidos de Ayotzinapa (2015); en Ecuador con el Colectivo Yasunidos (2014) para evitar la explotación petrolera en el Yasuní-ITT; y en Bolivia, para detener la construcción de la carretera que pasaría por el Territorio Indígena y Parque Nacional Isiboro-Sécure, TIPNIS (2013). Estas cuatro expresiones de protesta y movilización, analizadas desde la teoría de la Sociedad en Movimiento, desarrollada por el uruguayo Raúl Zibechi, se diferencian de aquellas que se dieron para enfrentar, por ejemplo, a los gobiernos neoliberales. Son otros los actores, otras las formas de resistencia asumidas, otras las consignas utilizadas, otras las demandas planteadas, otros los patrones de significación.
