Por su naturaleza, el Estrecho de Gibraltar se enfrenta a una, cada vez mayor, degradación de su medio ambiente marino, consecuencia, entre otras, de la ausencia de un marco jurídico adaptado a su particularidad. Y es que, al día de hoy los estrechos utilizados para la navegación internacional, carecen de una normativa específica que responda a esta situación. De hecho, podría afirmarse que la CNUDM es el único tratado internacional que, de forma expresa, hace referencia en su articulado a la protección del medio marino de los estrechos de navegación internacional. Por lo que se refiere al Estrecho de Gibraltar, cabe señalar que la dificultad de proteger su medio ambiente aumenta debido a su ubicación geoestratégica y a la existencia de una latente controversia de soberanía sobre sus aguas. Circunstancias todas ellas que dificultan la consecución de cualquier acuerdo internacional entre los Estados ribereños, que pueda servir de base para la fijación de un marco jurídico eficaz de protección. En este contexto, sería deseable que los Estados ribereños relegaran a un segundo plano sus disputas históricas con el fin de evitar y/o disminuir el impacto de la contaminación y la degradación de sus aguas. El éxito de este desafío podría dar lugar a la conclusión de un acuerdo internacional que podría representar un modelo de referencia aceptable en el Derecho internacional. Sin embargo, nadie puede ignorar el hecho de que esta solución se presenta muy difícil en la praxis, sobre todo si tenemos en cuenta que, además de la controversia hispano-marroquí, existen otros actores y sujetos jurídicos con intereses en el Estrecho, piénsese por ejemplo en Reino Unido (presente a través de la colonia de Gibraltar) o en organizaciones internacionales como la Unión Europea o la Organización Marítima Internacional. Junto a ellos, también hay que tener en cuenta las divergentes posiciones que, en relación con el medio marino, mantienen las ONGs de la zona, las multinacionales o los Estados usuarios del Estrecho de Gibraltar. Realidad ésta que hace necesario un detallado análisis y un estudio en profundidad del tema.

The Alboran Sea represents a regional Mediterranean space where North and South worlds merges, creating a geopolitical region where marine resources and maritime activities should be managed from a national and international perspectives. It is widely known, that currently the planet is suffering a global change, and it is also affecting the Alboran Sea, its ecosystems and populations. An important first step to update a paramount vision on this region is to understand the climatic, geologic and oceanographic, including biochemical cycles, process which shapes the rich geodiversity, biodiversity, the productivity, and the sustainable use of the marine resources from Alboran Sea. The fisheries management system should take into account marine environmental variability to achieve biological sustainability of marine resources. Well-funded policy-makers’ decisions require a sound science based knowledge of the interaction between the marine environment and commercial stocks. This is because the role of marine environment in the evolution of fish stocks is sometimes even more important than the one played by fishers in the commercial exploitation of them. Finally, we should analyze the different aspects of political context that could affect the management of the resources from Alboran Sea in the context of climate change. This book reviews different aspects of the Alboran Sea to help understand the current situation from the original Tethis Ocean. The book is divided into four blocks: (i) Oceanographic, geological and ecological context (chapters 2 to 7), (ii) biodiversity and ecosystems distribution (chapters 8 to 12), (iii) fisheries resources and aquaculture (chapters 13 to 20), and (iv) conservation, management and marine polices (chapters 21 to 25).
