Recientes leyes en materia de Derecho de Familia se han fundamentado en “el libre desarrollo de la personalidad”. Es el caso de las que han regulado el llamado popularmente “divorcio-exprés”, o la transexualidad, o el matrimonio de los homosexuales. Antes de dichas leyes, este principio constitucional no había ejercido un influjo tan directo en el Derecho civil. Lo cual no dejaba de ser extraño en cuanto que el Derecho civil como Derecho protector de la persona debería ser quizás la parte del ordenamiento jurídico más susceptible de tal influencia. Probablemente la razón se pudiera encontrar en los propios civilistas, todavía poco acostumbrados a unir, en la práctica, Constitución y Derecho civil. O también que el Tribunal Constitucional se ha mostrado reacio a utilizar este principio como criterio decisor en sus sentencias. Y, sin embargo, la consideración de este principio en el ámbito civil nos parece que podría ejercer un influjo vivificante en las diversas instituciones , poniendo de relieve que nuestra disciplina es la mejor aliada de la Constitución en su misión de situar a la persona como centro y justificación del ordenamiento jurídico, sin perjuicio, lógicamente, que la Carta Magna pudiera crear su propio estatuto constitucional de la persona.
