Este estudo reflete de modo exaustivo e crítico sobre o alcance sistémico da diferenciação normativa na unidade do Direito da União Europeia e constitui um contributo para a respetiva teorização dogmática. O sistema jurídico da integração europeia sedimentou-se através de instrumentos regulatórios e princípios que promoveram a uniformidade segundo um paradigma estadual federal que se apartou da génese internacional. Contudo, não podem ignorar-se os limites deste sistema e impõe-se reconhecer que a diferenciação normativa é incontornável e foi positivada, seja no nível primário, v.g na moeda, seja no nível secundário, v.g na cooperação reforçada. A diferenciação normativa emerge como um princípio do Direito da União Europeia.
