La libertad condicional es el diamante en bruto de nuestro sistema de ejecución penal. El art. 25.2 de la Constitución establece que “las penas privativas de libertad y las medidas de seguridad estarán orientadas hacia la reeducación y reinserción social”, pero el potencial que tiene esta institución para mejorar la convivencia comunitaria rebasa con creces dicho propósito. Lejos de servir únicamente a la resocialización de quienes hubieran infringido la norma, la libertad condicional constituye un espacio de encuentro y confluencia social desde el que poder potenciar la concepción restaurativa de la justicia penal. Aun así, dado que el legislador penal del año 2015 trastocó el sentido de toda la institución para convertirla en una forma de suspensión de la ejecución de la pena, nuestro sistema progresivo se ha visto desprovisto del último de sus grados de clasificación penitenciaria. Hasta el momento de la reforma, la libertad condicional evidenciaba que la base de nuestro sistema de ejecución penal era el paulatino otorgamiento de confianza al reo, pero el modelo vigente permite sostener que la pena retributiva se ha vuelto a anteponer a la resocializadora. Los efectos y consecuencias que dicha transmutación supone, además de dar lugar a numerosos conflictos de tipo práctico, alejan la ejecución penitenciaria de la consecución de los fines constitucionales de reeducación y reinserción social. Este trabajo se divide en tres partes al efecto de analizar todas estas cuestiones en detalle. La primera de ellas se ocupa de responder al qué y al para qué de la institución; la segunda revisa el régimen jurídico de la libertad condicional; y la tercera, por la perspectiva crítica y práctica de todo el trabajo, se dedica íntegramente a formular propuestas de lege ferenda con el ánimo de mejorar, no únicamente la funcionalidad de la libertad condicional strictu sensu, sino también su armonización general en el contexto de una ejecución penal con potencial restaurativo.Laura Delgado Carrillo nace a finales de 1990 en el Vallés Occidental, en la provincia de Barcelona. Estudia Derecho en la UAH y cursa formación de Máster con miras a dedicarse a la protección de los derechos humanos, pero en el año 2014 se adentra en el mundo de las prisiones y, con ello, en un intenso proceso de transformación personal. A partir de ese momento, todas sus aspiraciones se redefinen en torno al compromiso y la sensibilidad que desarrolla hacia quienes cumplen condena. Su implicación la aboca al ejercicio de la abogacía penitenciarista, pero también al ámbito de la docencia y la investigación de la UNED, del que ahora emana el presente título. Incondicional de los ideales humanistas, del acompañamiento resocializador y de las segundas oportunidades, la autora está fuertemente convencida de que el sistema penal actual necesita virar hacia concepciones más restaurativas para que la reparación se erija como punto de encuentro entre las partes afectadas por el delito.

Release from prison is matter of increasing interest throughout Europe. This book provides a comparative analysis of the process of breach across ten different European jurisdictions by identifying and elaborating a number of key analytical themes through which the different systems can be compared and evaluated. It is informed by and hopes to advance the research activities of the COST Action IS1106 on Offender Supervision in Europe, particularly the Action’s work on developing new comparative methodologies to examine the process of decision-making involved in the breaching of offenders for non-compliance.
