This volume presents some of the findings from a project on various aspects of Alternative Dispute Resolution (ADR), including conciliation, mediation, and arbitration. To study the discursive practices of ADR today, an international initiative has been undertaken by a group of specialists in discourse analysis, law, and arbitration from more than twenty countries. The chapters in this volume draw on discourse-based data (narrative, documentary and interactional) to investigate the extent to which the 'integrity' of ADR principles is maintained in practice, and to what extent there is an increasing level of influence from litigative processes and procedures. The primary evidence for such practices comes from textual and discourse-based studies, ethnographic observations, and narratives of experience on the part of experts in the field, as well as on the part of some of the major corporate stakeholders drawn from commercial sectors.

La present obra constitueix un comentari sistemàtic i complet a cadascun dels articles del llibre primer del Codi civil de Catalunya, que com a aportació destacada ordena i relaciona la jurisprudència que l’ha aplicat. L’aprovació de la Llei 29/2002, de 30 de desembre, Primera Llei del Codi civil de Catalunya, va suposar l’inici del procés de codificació i refosa del nostre dret en un únic cos normatiu. Des de la seva entrada en vigor, l’1 de gener de 2004, tant les matèries relatives a prescripció i a caducitat del llibre primer, com les pròpies de les disposicions preliminars, han donat lloc a un important cos jurisprudencial en la seva aplicació. Les normes sobre fonts del dret, interpretació i integració, territorialitat, dret comú, preferència i supletorietat, així com els principis informadors del dret civil català, el de llibertat civil, la bona fe, els actes propis o l’equitat, junt amb les relatives a disposicions generals sobre prescripció, interrupció i suspensió, terminis i còmput, com les de caducitat, han tingut un important impacte en la pràctica del dret civil a Catalunya. En els darrers anys, els tribunals de justícia han hagut d’afrontar l’aplicació d’una normativa nova no exempta de dificultat i, en ocasions de polèmica, però que s’ha resolt per la vigència general del dret català en diversos centenars de resolucions judicials.
