Opening a new area in Latin American studies, The Birth of the Penitentiary in Latin America showcases the most recent historical outlooks on prison reform and criminology in the Latin American context. The essays in this collection shed new light on the discourse and practice of prison reform, the interpretive shifts induced by the spread of criminological science, and the links between them and competing discourses about class, race, nation, and gender. The book shows how the seemingly clear redemptive purpose of the penitentiary project was eventually contradicted by conflicting views about imprisonment, the pervasiveness of traditional forms of repression and control, and resistance from the lower classes. The essays are unified by their attempt to view the penitentiary (as well as the variety of representations conveyed by the different reform movements favoring its adoption) as an interpretive moment, revealing of the ideology, class fractures, and contradictory nature of modernity in Latin America. As such, the book should be of interest not only to scholars concerned with criminal justice history, but also to a wide range of readers interested in modernization, social identities, and the discursive articulation of social conflict. The collection also offers an up-to-date sampling of new historical approaches to the study of criminal justice history, illuminates crucial aspects of the Latin American modernization process, and contrasts the Latin American cases with the better known European and North American experiences with prison reform.

This book analyzes the development of female prostitution in the Pacific port of Puntarenas, Costa Rica during the advanced stage of the coffee exporting economy (1880-1930), at the height of the consolidation of the liberal state. Hayes argues that prostitution in the port differed from that of the coffee producing highlands due to differential economic, social, and political development. In the periphery of Puntarenas, the development of prostitution reflected a less stigmatized view of sexual commerce than that of the highlands, where prostitution, although legal, threatened the tenets of liberal nationalism based on racial homogeneity and family values. Women of the highlands were encouraged to reproduce the nation's "more European" stock of workers and to ensure the legal transference of property through legal church marriages - both part of a design to stabilize the coffee exporting project. By contrast, prostitutes and other working women of Puntarenas, many immigrants from the "less European" populations of neighboring regions and most in concubinage, were freer to do what the law prescribed - register as prostitutes in legitimate trade. Such regional disparities reveal weaknesses in traditional explanations of Costa Rican exceptionalism, which have rested on the premise of cultural homogeneity and have reflected the realities of only one region of the country. The book advances an alternative explanation for the development of the nation's more democratic institutions, situating Costa Rican exceptionalism in the nation's free labor system, of which the labor prostitute in Puntarenas provides an example.

This collection examines the mutually influential interactions of gender and the state in Latin America from the late colonial period to the end of the twentieth century. Locating watershed moments in the processes of gender construction by the organized power of the ruling classes and in the processes by which gender has conditioned state-making, Hidden Histories of Gender and the State in Latin America remedies the lack of such considerations in previous studies of state formation. Along these lines, the book begins with two theoretical chapters by the editors, Elizabeth Dore and Maxine Molyneux. Dore opens by arguing against the prevailing view that the nineteenth century was marked by a gradual emancipation of women, while Molyneux considers how various Latin American state forms—liberal, corporatist, socialist, neoliberal—have more recently sought to incorporate women into their projects of social reform and modernization. These essays are followed by twelve case studies that examine how states have contributed to the normalization of male and female roles and relations. Covering an impressive breadth not only of historical time but also of geographical scope, this volume moves from Brazil to Costa Rica, from Mexico to Chile, traversing many countries in between. Contributors explore such topics as civic ritual in Bolivia, rape in war-torn Colombia, and the legal construction of patriarchy in Argentina. They examine the public regulation of domestic life, feminist lobby groups, class compromise, female slaves, and women in rural households—distinct, salient aspects of the state-gender relationship in specific countries at specific historical junctures.
